ASSESSMENT OF COSTS - REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]       This is an appeal from a Federal Court judgment dismissed with costs on January 13, 2003. The present assessment proceeded without a personal appearance by the parties.

[2]       Once costs are awarded by the Court, the function of the assessment officer is to determine the amount thereof in keeping with the Federal Court Rules, 1998, and Tariff B. Based on the submissions of the parties, therefore, it seems reasonable to allow the respondent the sum of $1,342.00 for services rendered under items 19 (5 units), 22(a) (2 units x 2h06) and 26 (3 units). The expenses incurred in this case in the amount of $45.41 are awarded as requested.

[3]       The respondent's bill of costs is assessed in the amount of $1,387.41. A certificate is issued for that amount.
