[1] On March 21, 2000, the Federal Court of Appeal allowed the appeal and the decision of the Tax Court Judge was set aside. Costs on the motion before the Tax Court Judge and on the appeal were awarded against the Appellant. The Respondent filed a Bill of Costs and requested an oral assessment. Upon reviewing the Bill of Costs, this assessment officer deemed that this assessment would be better serviced with written submissions without personal appearance. Directions were issued to both parties setting a timetable for serving and filing of materials, including written submissions. In a letter dated April 16, 2002, counsel for the Appellant wrote that he was no longer representing the Appellant and requested a three (3) weeks extension for the Appellant to serve and file reply materials. The extension was granted. Even with the extension, the Appellant failed to serve and file a response.
[2] In absence of a response from the Appellant, I examined the items claimed in the Respondent's Bill of Costs to ensure that they were within the parameters of the Federal Court Rules, 1998 and Tariff B. I am satisfied that the supporting materials justify the Respondent's Bill of Costs and I allow it as presented at $955.01.
