Docket: A-78-06

Citation: 2006 FCA 182

Present:          PELLETIER J.A.

BETWEEN:

JAMES RUSSELL BAIRD

Appellant

and

HER MAJESTY THE QUEEN

Respondent

Dealt with in writing without appearance of parties.

Order delivered at Ottawa, Ontario, on May 18, 2006.

REASONS FOR ORDER BY:                                                                                 PELLETIER J.A.

Date: 20060518

Docket: A-78-06

Citation: 2006 FCA 182

Present:          PELLETIER J.A.

BETWEEN:

JAMES RUSSELL BAIRD

Appellant

and

HER MAJESTY THE QUEEN

Respondent

REASONS FOR ORDER

PELLETIER J.A.

[1]                The respondent Her Majesty the Queen seeks an order for security for costs in the appeal from the dismissal of the appellant John Baird's Statement of Claim, as well as with respect to the appellant's motion for an extension of time to file Notices of appeal with respect to the dismissal of two interlocutory motions.

[2]                It is clear from the respondent's material that the appellant has no sense of relevance or proportion in the preparation of the material which he files in support of his various proceedings. In that regard, he resembles countless other self-represented litigants. His conduct is not so egregious that this Court should gag him by an order for security for costs.

[3]                Mr. Baird will have to comply with the Federal Courts Rules with respect to the length of his memorandum in the appeal.

[4]                The motion for security for costs, and the incidental relief sought, will be dismissed.

[5]                In a separate order, I have dismissed Mr. Baird's motion for an extension of time to file notices of appeal from the dismissal of his interlocutory appeals. Consequently, the respondent does not need an extension of time to respond to that motion.
