[1] We do not need to hear you, Mr. Lamek. Counsel for the appellant has not succeeded in convincing us that our intervention could be justified here. We have no reason to think that the learned motions judge has wrongly exercised her discretion in refusing the extension of time sought. Her reasons could have been more elaborate and she could have used, when speaking of the existence of a serious issue to be tried, a more appropriate word than "evidence." There is also no doubt that she has applied the principles involved with particular strictness. But, on the whole, it appears to us that she weighed all the factors that could have some bearing, and she did not make, in doing so, any palpable and reviewable error. In the end, it is our conviction that justice, with respect to the whole controversy, did not really require that the extension of time to appeal the incidental order involved be granted.
[2] The appeal will be dismissed with costs.
