[1] This is the assessment of the Respondent's costs following dismissal of the appeal and the awarding of costs to the Respondent.
[2] The Respondent submitted an amended bill of costs for assessment and requested that the assessment proceed by way of written submission. I issued a timetable for disposition of the bill of costs to be done in writing without personal appearance of the parties. This timetable was sent to both parties by registered mail.
[3] Mr. Mockler Q.C., solicitor for the appellant , was given until August 11, 2003 to serve and file written representations is response to the respondents bill of costs. To date none have been received. Therefore, the assessment will proceed on the basis of the documentation on file.
[4] Counsel for the respondent prepared the bill of costs in accordance with column III of the table to Tariff B of the Federal Court Rules, 1998 pursuant to Rule 407. It is noted that each item requested is sought at the minimum number of units in the scale in column III.
[5] The Respondent requested payment of the Bill of Costs in letters dated November 27, 2002, February 3, 2003 and February 11, 2003. No payments have been received to date.
[6] The Respondent's bill of costs is assessed and allowed, as requested, in the amount of $1,320.00 for assessable fees and $77.00 for disbursements. A certificate shall be issued for the amount of $1,397.00.
