Date: 19991217

Docket: A-597-98

CORAM:      ISAAC, J.A.

         McDONALD, J.A.

         SEXTON, J.A.

BETWEEN:

         SALVATORE GRAMAGLIA

     Appellant

     - and -

     THE ATTORNEY GENERAL OF CANADA

     Respondent

     REASONS FOR JUDGMENT

(Delivered from the Bench at Calgary (Alberta)

     on Friday, December 17, 1999)

ISAAC, J.A.:

[1]      This is an appeal from an order made by a Motions Judge in the Trial Division, which dismissed the appellant's application for judicial review of a decision of the Vice-Chairman of the Pension Appeals Board dated 6 May, 1997. In his decision the Vice-Chairman refused leave to the appellant to appeal to the Pension Appeals Board from a decision of a Review Tribunal under the Canada Pension Plan.

[2]      We did not find it necessary to call upon counsel for the respondent to make any argument because, after hearing argument from the appellant, who was self-represented, we were all of the view that the appellant did not demonstrate to us that in making the discretionary order that he did, the learned Motions Judge made any error in principle or in law or that he misapprehended the facts of the application before him.

[3]      We would therefore dismiss the appeal.
