[1] On August 30, 2002, counsel for the respondent filed his bill of costs for assessment, pursuant to the judgment of the Court dismissing the appeal with costs.
[2] In a letter accompanying his bill, Mr. Guimond, representing the respondent, asked that the assessment proceed without a hearing and on the basis of the evidence submitted. Letters were therefore sent to the parties inviting them to file and serve their submissions in writing and none were submitted within the prescribed periods.
[3] Absent any dispute, the bill of costs of the respondent is assessed and allowed as requested, except for the request under item 26, which will be reduced to $220.00.
[4] The costs of the respondent are assessed and allowed in the amount of $1,234.28. A certificate shall issue in that amount.
