[1] This assessment of costs is further to a judgment of the Court (Richard, C.J., Létourneau, Nadon, JJ.A.) dated October 17, 2002 dismissing the application for judicial review with costs.
[2] On September 19, 2002, counsel for the respondent filed a bill of costs together with an affidavit of Nathalie Lessard and a request for a decision without personal appearance of parties.
[3] On November 3, 2003, a copy of the bill of costs was sent to the applicants so they could submit written representations. Considering that no representations had been yet filed, I am now ready to assess the costs in favour of the respondent.
[4] With the exception of item 26, all other fees are allowed. Item 26 is reduced to 2 units as there was no opposition.
[5] Disbursements in the amount of $ 1,583.51 are awarded, since they are regarded as reasonable and were proven by the affidavit of Nathalie Lessard.
[6] The bill of costs is accordingly assessed and allowed in the amount of $ 3,013.51.
