[1]                This is an appeal from a Trial Division judgment which was dismissed with costs on January 8, 2001.

[2]                Counsel for the respondent, Claude Morissette, filed his bill of costs on October 12, 2001, and asked that it be taxed without a personal appearance by the parties. As no written submissions have been made by the appellant within the specified deadlines, we will proceed to assess the respondent's bill.


[3]                Counsel for the respondent claimed compensation for the following fees:

item 19 5 units

item 22(a)          2 units

item 25 1 unit

item 26 4 units

[4]                These claims seem reasonable to me in the circumstances and will be allowed.

[5]                The costs of printing, service and travel amount to $789.69. These costs will be allowed since they were proven in Lynne Lasalle's affidavit.

[6]                The respondent's costs are accordingly assessed and allowed in the amounts of $1,430.00 for fees and $789.69 for disbursements. A certificate will be issued in the amount of $2,219.69.
