The Rules Committee of the Federal Courts

The Rules Committee of the Federal Court of Appeal and of the Federal Court, established under section 45.1 of the Federal Courts Act, guarantees the reliability and clarity of these Courts’ Rules. Its mandate is to review the rules of practice and procedure before these Courts and recommend amendments or additions. The Rules Committee also suggests amendments if new federal legislation is introduced that might have an impact on cases that are dealt with by the Federal Court of Appeal.

The Rules Committee is composed of the Chief Justice of the Federal Court of Appeal, who acts as the Chair, and the Chief Justice of the Federal Court; three judges designated by the Chief Justice of the Federal Court of Appeal and five judges designated by the Chief Justice of the Federal Court; the Chief Administrator of the Courts Administration Service; a representative of the Attorney General and five members of the bar of any province designated by the Attorney General of Canada, after consultation with the Chief Justice of the Federal Court of Appeal and the Chief Justice of the Federal Court, who themselves make a practice of consulting the Canadian Bar Association. It is important to note that these lawyers are selected in a way that ensures the representation of the various regions of the country and the various fields of law in respect of which the Federal Court of Appeal and the Federal Court have jurisdiction.

Meetings of the Rules Committee

The Rules Committee usually meets twice a year, but can meet more or less often depending on the need.

Public consultation

The Rules Committee of the Federal Court of Appeal and the Federal Court has struck a subcommittee to examine the issue of expert witness in cases before the two Courts. The subcommittee has drafted a discussion paper and invites your comments on the proposals.
