[1] On March 30, 2006, the Court dismissed with costs the application for judicial review commenced by the applicant. At the request of the respondent, the assessment of its bill of costs proceeded on the basis of the parties' written submissions.
[2] Having examined the record, the fees are allowed in the amount of $1,256 which seems reasonable compensation in this case. Since no explanation has been given by the respondent to justify the maximum of number of units claimed under Tariff B, I have reduced the number of units claimed as follows: items 2 (5 units), 13 (3 units), 14 (2 units/hr X 14 min.) and 26 (2 units). In answer to Mr. Bruni's submissions, I should like to point out that the Assessment Officer cannot refuse to go ahead with the assessment of costs when the latter have been awarded by the Court.
[3] As to the disbursements incurred in this case, they are allowed as requested in the amount of $617.17.
[4] The respondent's costs are therefore assessed and allowed in the amount of $1,873.17. A certificate shall be issued for that amount.
