ASSESSMENT OF COSTS - REASONS
[1] At the request of the respondent, the assessment of his bill of costs proceeded without personal appearance of the parties. To date, we have not received any reply to our letter dated April 12, 2005, directing the appellant to submit his written submissions by May 6, 2005.
[2] After reviewing the proceedings in the file and the evidence submitted, the respondent's fees are assessed in the amount of $2,970 for the following items of Tariff B: items 19 (7 units), 22 (3 units X 6 hours) and 26 (2 units). The claims made under item 21 are refused because the orders made on motions heard in accordance with rule 369 of the Federal Court Rules are silent on the issue of costs. We have reduced the number of units for the assessment of costs given that none of it was disputed. With respect to the disbursements incurred in this appeal, they are awarded as claimed in the amount of $2,137.81.
[3] Accordingly, the respondent's costs are assessed and allowed in the amount of $5,107.81. A certificate is issued for that amount.
