![]() June 2007 Notice to CounselID/IAD Streamlining Pilot ProjectThe Immigration and Refugee Board of Canada (IRB) is implementing a pilot project in the Central Region involving the processing of certain cases for permanent residents who are inadmissible on grounds of serious criminality under s. 36(1)(a) and who have a right to appeal of a removal order decision to the Immigration Appeal Division (IAD). This will apply to cases which can be resolved on the consent of the parties and without the need for a hearing. Under the current process, it generally takes a year or longer from the time the file is referred to the IRB for an admissibility hearing to the conclusion of the removal order appeal. The proposed pilot project aims to reduce the processing time at the IRB to approximately 30 days. The Canada Border Services Agency (CBSA) has operated a Screening Unit in Toronto for the past five years which has provided an opportunity to appellants in removal order appeals to make submissions and discuss a possible joint recommendation to settle their IAD appeal. In appropriate cases, there have been joint recommendations of the Minister's counsel and the appellant's counsel to the IAD to have the appellant's removal order appeal stayed for a number of years during which time the appellant must comply with particular conditions. The present paper hearing pilot project builds on the experience of CBSA and the Central Region IRB office, and will streamline the processing of these cases so that they can be decided more quickly without compromising fairness, and maximize efficiency at both the Immigration Division (ID) and the IAD. This approach will enhance efficiency of processing appropriate cases and optimize the use of resources for determining cases, including freeing up resources to deal with more complex cases.
