COMMISSIONER'S DIRECTIVE 081 - OFFENDER COMPLAINTS AND GRIEVANCES

Why was the policy changed?

The Offender Redress Division has revised CD 081 - Offender Complaints and Grievances to provide clarification for processing, analysing and responding to offender complaints and grievances.

What has changed?

CD 081 - Offender Complaints and Grievances has been amended to:

  • underline the paramount importance of the rule of law and human rights in resolving offenders' problems;
  • include cross references and definitions related to the offender complaint and grievance process;
  • provide clarification for processing complaints and grievances at all levels of the process;
  • extend timeframes for responding to high priority and routine priority third level grievances;
  • extend timeframes for grievers to submit grievances to the next level;
  • provide clarification for responding to special cases, including multiple grievers, referrals to an Inmate Grievance Committee or an Outside Review Board;
  • clarify provisions on consultation, alternate legal remedies, complaints to the Correctional Investigator, the 1-800 line and confidentiality of the complaint and grievance process; and
  • outline the requirements for processing, investigating and responding to harassment, sexual harassment and discrimination grievances.

How was it developed?

Consultations with Grievance Coordinators/ Clerks, Grievance Analysts, offenders and stakeholders, including the Correctional Investigator, were conducted regarding changes to major sections and technical amendments of CD 081 - Offender Complaints and Grievances. The changes represent clarifications for processing, analysing and responding to complaints and grievances at all levels of the complaint and grievance process.

Who will be affected by the policy?

Grievance Coordinators/Clerks, Grievance Analysts, those involved in the offender complaint and grievance process, and offenders.

Other impacts?

  • The Offender Complaint and Grievance Procedures Manual has been revised;
  • Training activities have been updated; and
  • Technical amendments have been made to the following Offender Redress Forms:
    • Offender Complaint Form (CSC/SCC 0360)
    • Offender Grievance Presentation (First Level) (CSC/SCC 0103)
    • Offender Grievance Presentation (Second Level) (CSC/SCC 0103-1)
    • Offender Grievance Presentation (Third Level) (CSC/SCC 0103-2)
    • Offender Grievance Response (Third Level) (CSC/SCC 0103-2A)
    • Offender Grievance Response (Third Level) (CSC/SCC 0103-2B)
    • Offender Grievance Response (Third Level) (CSC/SCC 0103-2C)
