Fish Harversters Receive Heavy Fines for Fishing Violations

PLACENTIA, NL – Mr. Aloysius Ryan and Cyril O’Leary, both of Fox Harbour, were convicted of netting salmon in coastal waters during a closed time.

Mr. Aloysius Ryan was fined $800 and received a two year probation period. He was also prohibited from fishing in coastal and inland waters except to fish commercially for two years. As well, the court forfeited to the Crown a dingy, salmon, mackerel and other fishing gear that had been seized from Mr. Ryan.

Mr. Cyril O’Leary was fined $1,600 and received a two year probation period. Mr. O’Leary was prohibited from fishing on coastal and inland waters for 10 years.

On July 3, 2007, fishery officers from the Placentia Detachment checked the Connor Cove area in response to earlier complaints of an illegal salmon net. Using night vision equipment they observed small floats on the water in the area of the frape (a rope that goes from the shore out into the water and is anchored in place so a net can be hauled in from shore). A further inspection of the area confirmed an illegal net. The officers observed Mr. O’Leary and Mr. Ryan haul the illegal net.

Harrison Critch and Greg Flight of Paradise, and Kevin Stamp of Mount Pearl were convicted of fishing scallops during a closed time.

They each received a $1,000 fine and forfeited a total of 138 scallops to the Crown.

On August 18, 2007, fishery officers from the Placentia Detachment were informed that a few people were diving for scallops in a closed area in Ship Harbour. Fishery officers, with the assistance of an inland fisheries enforcement officer, proceeded to the area and apprehended the three individuals for fishing scallops in a closed area. The area where these individuals were apprehended was a contaminated area, closed to scallop harvesting.

Mr. Edward O’Brien of Dunville was convicted of fishing on a scheduled river without a licence. Mr. O’Brien was fined $250. He also forfeited a fly rod, reel, barbed hook and one brook trout to the Crown.

On June 4, 2007, while on patrol on Beaver River, a fishery guardian from the Placentia Detachment carried out an inspection on Mr. Edward O’Brien. The inspection revealed that Mr. O’Brien did not have a valid salmon licence and was angling with a barbed hook.

These six fish harvesters were convicted on September 4, 2007 in Placentia Provincial Court.
