Chemical Substances in Batch 3 of the Challenge

On August 18, 2007, the Minister of the Environment and the Minister of Health released a Notice in the Canada Gazette for the third group of substances identified under the Challenge, entitled: Notice of third release of technical information relevant to substances identified in the challenge. Industry and interested stakeholders are invited to submit any information that may be used to inform risk assessment and to develop and benchmark best practices for risk management and product stewardship.

Section 71 Survey Notice

The following Notice, issued under section 71 of the Canadian Environmental Protection Act, 1999, entitled: Notice with respect to certain Batch 3 Challenge substances applies to the 19 substances in the third group identified under the Challenge.

Every person to whom the Notice applies must comply with the Notice by no later than 3:00 p.m. EDT, December 18, 2007. Please note that under subsection 71(4) of the Act extensions for a maximum of two months may be granted in some cases on written request. To apply for an extension, a written request and justification must be received by the Minister of the Environment prior to the deadline.

Questionnaire

In addition, Industry and interested stakeholders are also invited to submit, within six months (on or before February 19, 2008), further information regarding the scientific properties of these substances, or best management practices associated with the use of these substances that might contribute to improved decision-making. Information on the type of information that could be submitted, and logistics for submitting information is detailed in the Challenge Questionnaire and related Guidance Document below.

Timelines

18 December 2007 Deadline for submission of information under the section 71 notice on "batch 3" substances (if no extension granted)
19 February 2008 Deadline for submission of additional information by interested stakeholders, including on the extent and nature of the management/stewardship of "batch 3" substances.
No later than 24 May 2008 If no information received:
Publication in Canada Gazette and start of 60-day public comment period on (a) the draft screening assessment, and (b) the proposal to pursue one of the measures as specified under subsection 77(2)
No later than 23 August 2008 If specified information is received:
Publication in Canada Gazette and start of 60-day public comment period on (a) the draft screening assessment, (b) the new information received, and (c) the proposal to pursue one of the measures as specified under subsection 77(2)
No later than 22 November 2008 When no information is received during challenge period:
Publication in Canada Gazette of final assessment recommendation under subsection 77(6) and release of risk management approach
No later than 21 February 2009 When information is received during challenge period:
Publication in Canada Gazette of final assessment recommendation under subsection 77(6) and release of risk management approach

Information Workshops for Stakeholders

Environment Canada and Health Canada will consider hosting information workshops in late September or early October 2007 should the number of requests received from interested stakeholders warrant this.

The information workshops would be designed to help further explain to stakeholders the Challenge, the associated documentation and how to participate. It should be emphasized that the objectives of the workshop would be for federal officials to provide details on what information is being sought for the Challenge, how participants are to submit this information, and the associated timelines. Discussion would focus on the documents associated with the Challenge which are provided on this website.
