Notice is hereby given that the Governor in Council, pursuant to subsection 65(1) and (6) of the Canada Marine Act (see footnote a) , proposes to make the annexed Regulations amending the Public Ports and Public Port Facilities Regulations. Interested persons may make representations with respect to the proposed Regulations to the Minister of Transport within 30 days after the date of publication of this notice. All such representations should cite the Canada Gazette, Part I, and the date of publication of this notice. REGULATIONS AMENDING THE PUBLIC PORTS AND PUBLIC PORT FACILITIES REGULATIONS AMENDMENTS 1. The Public Ports and Public Port Facilities Regulations (see footnote 1) are amended by adding the following after section 3: 3.1 The designation of Esquimalt as a public port under section 1 is repealed. 3.2 The designation of Nanoose Bay as a public port under section 1 is repealed. 2. The name and description of Esquimalt in Part 6 of Schedule 1 to the Regulations are deleted. 3. The name and description of Nanoose Bay in Part 6 of Schedule 1 to the Regulations are deleted. 4. The description of Victoria in Part 6 of Schedule 1 to the Regulations is replaced by the following: All the navigable waters, including any foreshore, from a line running from the Ogden Point breakwater in a westerly direction to the southern end of Macauley Point northward to the Trestle Bridge. COMING INTO FORCE 5. (1) Sections 2 and 4 of these Regulations and section 3.1 of the Public Ports and Public Port Facilities Regulations, enacted by section 1 of these Regulations, come into force on the day on which the navigable waters of the natural or man-made harbour of Esquimalt are designated by the Governor in Council under subsection 104(2) of the Canada Marine Act. (2) Section 3 of these Regulations and section 3.2 of the Public Ports and Public Port Facilities Regulations, enacted by section 1 of these Regulations, come into force on the day on which the navigable waters of the natural or man-made harbour of Nanoose Bay are designated by the Governor in Council under subsection 104(2) of the Canada Marine Act.
