PROPOSED REGULATORY TEXT

Notice is hereby given, pursuant to subsections 111(1) (see footnote a) and 562.12(1) (see footnote b) of the Canada Shipping Act, that the Governor in Council, pursuant to subsections 110(1) (see footnote c) and 562.1(1) (see footnote d) of that Act, proposes to make the annexed Regulations Amending the Crewing Regulations.

Ship owners, masters, seamen and other interested persons may make representations with respect to the proposed Regulations to the Minister of Transport within 90 days after the date of publication of this notice. All such representations must be in writing and should cite the Canada Gazette, Part I, and the date of publication of this notice, and be sent to Robert Turner, Manager, Navigation Safety and Radio Communication, Ships and Operations Standards, Marine Safety Directorate, Department of Transport, Place de Ville, Tower C, 330 Sparks Street, Ottawa, Ontario K1A 0N8. REGULATIONS AMENDING THE
CREWING REGULATIONS

AMENDMENTS

1. Paragraph 40(2)(a) of the Crewing Regulations (see footnote 1) is amended by striking out the word "and" at the end of subparagraph (i), by adding the word "and" at the end of subparagraph (ii) and by adding the following after subparagraph (ii):

    (iii) if an electronic chart display and information system (ECDIS) accompanied by back-up arrangements is being used to fulfil the chart requirements set out in section 5 of the Charts and Nautical Publications Regulations, 1995,
      (A) holds a certificate of the person's successful completion of training, at a recognized institution, in ECDIS operation, and
      (B) has been provided by the master with written instructions in the operation of, and has been familiarized with, the ECDIS and back-up arrangements carried on board the ship;

2. Paragraph 52(2)(a) of the Regulations is amended by striking out the word "and" at the end of subparagraph (i), by adding the word "and" at the end of subparagraph (ii) and by adding the following after subparagraph (ii):

    (iii) if an electronic chart display and information system (ECDIS) accompanied by back-up arrangements is being used to fulfil the chart requirements set out in section 5 of the Charts and Nautical Publications Regulations, 1995,
      (A) holds a certificate of the person's successful completion of training, at a recognized institution, in ECDIS operation, and
      (B) has been provided by the master with written instructions in the operation of, and has been familiarized with, the ECDIS and back-up arrangements carried on board the MODU;

COMING INTO FORCE

3. These Regulations come into force on the day on which they are registered.
