REGULATORY IMPACT (This statement is not part of the Proclamation.) Description The Canadian Beef Cattle Research, Market Development and Promotion Agency Proclamation (SOR/2002-48), made under Part III of the Farm Products Agencies Act, establishes the Canadian Beef Cattle Research, Market Development and Promotion Agency, provides for the manner and terms of appointments to the Board of Directors of the Agency; and specifies the terms of the promotion and research plan that the Agency is empowered to implement. The Proclamation provides that the specified provincial cattle associations nominate persons to be members of the Agency to represent primary producers. The Proclamation also allows the Agency to appoint those associations to collect levies on behalf of the Agency. The organizations for British Columbia, Alberta, Saskatchewan and Nova Scotia were incorrectly identified in the Proclamation and the proposed amendments correct this. For the Province of British Columbia, the "British Columbia Cattlemen's Association" is changed to the "Cattle Industry Development Council". For the Province of Saskatchewan, the "Saskatchewan Stock Growers' Association" is changed to "The Minister of Agriculture, Food and Rural Revitalization or such other member of the Executive Council of Saskatchewan to whom the administration of The Cattle Marketing Deductions Act, 1998, S.S. 1998, c. C-3.1", is assigned. For the Province of Alberta, the "Alberta Cattle Commission" is changed to the "Alberta Beef Producers". For the Province of Nova Scotia, the "Nova Scotia Cattlemen's Association" is changed to the "Nova Scotia Cattle Producers". In the interests of clarity, all definitions of provincial cattle associations have been listed in the amendments to the Proclamation. As well, subsection 10(5) of the schedule to the Proclamation has been amended to allow the Agency, with the concurrence of the provincial cattle association, to appoint either the provincial association or any other person to collect, on the Agency's behalf, the levies or charges imposed by any order or regulation. Alternatives No alternatives have been considered. Benefits and costs These amendments will enable the provinces of British Columbia, Alberta, Saskatchewan and Nova Scotia to enter into service agreements with the Agency, allowing those provinces, on behalf of the Agency, to collect levies on cattle marketed interprovincially. Consultation The Agency has been working with the provinces on a bilateral basis to develop the necessary legal framework for the provinces to be able to collect and remit levies to the Agency on beef cattle marketed interprovincially. This work has been ongoing since the Agency was proclaimed in 2002. During the course of drafting the legal documents to support the levy collection system, it was noted that the organizations authorized by the provinces of British Columbia, Alberta, Saskatchewan and Nova Scotia to collect levies within the province were incorrectly identified in the Proclamation. The Agency has had ongoing discussions and reporting of activities with producer members of the provincial cattle associations during the drafting of the levy orders. All provincial cattle producer members in turn report on activities to the grass-roots membership during producer meetings. All provincial cattle associations have consulted with their respective government supervisory bodies during this process. Compliance and enforcement These amendments will ensure that the correct associations will be used to nominate persons to be members who will represent primary producers and to collect levies on behalf of the Agency. PROPOSED REGULATORY TEXT Notice is hereby given that the Governor in Council, pursuant to subsection 39(1) (see footnote a) and section 40 (see footnote b) of the Farm Products Agencies Act (see footnote c), proposes to direct that a proclamation be issued amending the Canadian Beef Cattle Research, Market Development and Promotion Agency Proclamation in accordance with the annexed schedule. Interested persons may make representations with respect to the proposed Proclamation within 15 days after the date of publication of this notice.
