Vol. 139, No. 13 — March 26, 2005 Directions Repealing the Directions to the Canadian Dairy Commission (Export Dairy Products)Statutory authority Canadian Dairy Commission Act Sponsoring department Department of Agriculture and Agri-Food REGULATORY IMPACT (This statement is not part of the Directions.) Description Canada had deregulated the marketing of milk (and cream) for dairy product exports in response to a ruling of the Appellate Body of the World Trade Organization (WTO) in 1999. Commercial export milk (CEM) mechanisms were developed by dairy industry stakeholders, implemented through provincial deregulation, and accommodated by federal deregulation. Federal deregulation included Directions to the Canadian Dairy Commission (Export Dairy Products) that were issued by the Minister of Agriculture and Agri-Food under section 11 of the Canadian Dairy Commission Act, giving instructions to the Canadian Dairy Commission in the exercise of its powers with respect to CEM. Following a ruling by the WTO Appellate Body in December 2002 that the supply of CEM involves export subsidies, provinces amended their respective regulations to eliminate CEM. As part of consequential amendments to federal regulations, the Minister if repealing the Directions in their entirety.
