REGULATORY IMPACT
ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The safety of aircraft operating in the airspace surrounding our airports is of vital concern to private citizens and to federal and municipal governments. To ensure that obstacles do not intrude into this airspace, Transport Canada imposes height restrictions in accordance with the airport zoning provisions of the federal Aeronautics Act.

The current Waterloo-Guelph Airport Zoning Regulations were made in 1993. Since then the airport has expanded and the existing Regulations do not adequately protect to ensure the safe operation of the airport and aircraft. The proposed revision to the Regulations will limit the height of new buildings, structures and objects, or additions to any existing buildings, structures or objects, including objects of natural growth.

The Regulations will also prohibit lands adjacent to, and in the vicinity of, the Region of Waterloo International Airport from being used or developed in a manner that causes interference with any signals or communications between aircraft and/or between any facilities used to provide services relating to aeronautics. The Regulations will also restrict land uses and activities that attract birds hazardous to aviation safety.

No construction exceeding 45 metres above the airport reference point elevation will be permitted within a radius of approximately 4 000 metres of the airport reference point (the outer surface). More restrictive limitations will be imposed within the runway approaches and transitional surfaces.

In addition to the above, the existing name of the Regulations, the Waterloo-Guelph Airport Zoning Regulations, will be changed to the Region of Waterloo International Airport Zoning Regulations.

Alternatives

No alternative means provide adequate protection to the airspace over lands adjacent to, and in the vicinity of, the airport.

Airport zoning is the only legal method through which to limit the height of new buildings, structures and objects, including objects of natural growth; to prohibit electronic interference; and to restrict land uses and activities that attract birds hazardous to aviation safety. Without the legal protection of airport zoning regulations, development incompatible with the safe operations of a possible future airport may be permitted by provincial or municipal authorities.

Benefits and costs

With the amendment of airport zoning regulations, the airspace associated with the Region of Waterloo International Airport will be kept obstacle-free, increasing the safety of aircraft operating in the vicinity of the airport. The risk of electronic interference will be reduced and future communication and navigation services will be protected. By restricting land uses and activities attractive to birds, airport zoning regulations will reduce the risk of bird strikes.

Some landowners will be affected by the height and land use restrictions of the Region of Waterloo International Airport Zoning Regulations. However, there will be minimal social or environmental impact for Canadians. No existing structures will be removed directly and solely because of the Regulations. There will be no major negative effects on land development patterns or land values in the vicinity of the airport.

The costs of the Region of Waterloo International Airport Zoning Regulations amendment will be borne by the Regional Municipality of Waterloo. The only costs to Transport Canada are for technical expertise and for processing the amendment and are far outweighed by the benefits of increased safety for the Region of Waterloo International Airport operations.

Environmental assessment

In accordance with the Cabinet Directive on the Environmental Assessment of Policy, Plan and Program Proposals, and the Transport Canada Policy Statement on Strategic Environmental Assessment, a Preliminary Scan of this proposal was conducted. It concluded that the proposal is not likely to have important environmental implications and that a Detailed Analysis is not required.

Consultation

Transport Canada met with representatives from the affected municipalities on August 13, 2003, and briefed them on the proposed amendment to the Regulations. The municipalities affected are as follows: the Township of Wilmot, the Township of Guelph-Eramosa, the City of Guelph, the City of Kitchener, the City of Cambridge, the Township of Woolwhich, the Township of Puslinch, and the Regional Municipality of Waterloo, all in the county of Wellington. The municipalities all concur with the need to amend the Waterloo-Guelph Airport Zoning Regulations.

The amendment to the Waterloo-Guelph Airport Zoning Regulations will be published in the Canada Gazette, Part I, and a Notice of the amendment will be published in local newspapers. The full text of the amendment and plans will be published on the Transport Canada Web site.

There will be a 60-day formal public consultation period where any person may make a written representation to the Minister. The Region of Waterloo International Airport will hold one or more public information sessions, with representatives from the airport, Transport Canada, and Public Works and Government Services Canada in attendance, in order to afford the public an opportunity to obtain detailed information about the amendment and ask questions.

Compliance and enforcement

Department of Transport Civil Aviation Safety Inspectors will monitor compliance.

Notice is hereby given, pursuant to section 5.5 (see footnote a) of the Aeronautics Act, that the Governor in Council, pursuant to section 5.4 (see footnote b) of that Act, proposes to make the annexed Region of Waterloo International Airport Zoning Regulations.

Interested persons may make representations concerning the proposed Regulations to the Minister of Transport within 60 days after the date of publication of this notice. REGION OF WATERLOO INTERNATIONAL
AIRPORT ZONING REGULATIONS

INTERPRETATION

1. (1) The following definitions apply in these Regulations.

"airport" means the Region of Waterloo International Airport in the Province of Ontario, in the Township of Woolwich, in the Regional Municipality of Waterloo. (aéroport)

"airport reference point" means the point described in Part 1 of the schedule. (point de référence de l'aéroport)

"approach surface" means an imaginary inclined surface that extends upward and outward from each end of a strip surface; such approach surfaces are referred to as take-off/approach surfaces and are described in Part 2 of the schedule. (surface d'approche)

"bird hazard zone" means the area in the immediate vicinity of the airport as described in Part 7 of the schedule. (zone de péril aviaire)

"outer limit" means the limit of the area, as described in Part 6 of the schedule, covered by the approach surfaces, bird hazard zone, outer surface, strip surface and transitional surfaces. (limite extérieure)

"outer surface" means the imaginary surface located above and in the immediate vicinity of the airport, which surface is described in Part 3 of the schedule. (surface extérieure)

"strip surface" means an imaginary surface associated with an airport runway, prepared for the take-off and landing of aircraft in a particular direction, which surfaces are described in Part 4 of the schedule. (surface de bande)

"transitional surface" means an imaginary inclined surface that extends upward and outward from the lateral limits of a strip surface and an approach surface, which surfaces are described in Part 5 of the schedule. (surface de transition)

(2) For the purposes of these Regulations, the assigned elevation of the airport reference point is 311.500 m above sea level, Canadian Geodetic Vertical Datum – CGVD28, 1978 Adjustment.

APPLICATION

2. These Regulations apply in respect of all land, including public road allowances, that is adjacent to or in the vicinity of the airport within the limits described in Part 6 of the schedule.

BUILDING RESTRICTIONS

3. No person shall erect or construct on land in respect of which these Regulations apply, a building, structure or object, or an addition to an existing building, structure or object, the highest point of which would exceed in elevation at the location of that point

(a) an approach surface;

(b) the outer surface; or

(c) a transitional surface.

INTERFERENCE WITH COMMUNICATION

4. No owner or lessee of land within the outer surface shall permit any part of that land to be used or developed in a manner that causes interference with any signal or communication to or from an aircraft or any facility used to provide services relating to aeronautics.

NATURAL GROWTH

5. No owner or lessee of land in respect of which these Regulations apply shall permit an object of natural growth that is on the land to grow to a height that exceeds in elevation at the location of the object any surface referred to in section 3.

BIRD HAZARD

6. No owner or lessee of land within the limits of the bird hazard zone shall permit any part of that land to be used for activities or uses that attract birds that create a hazard to aviation safety.

REPEAL

7. The Waterloo-Guelph Airport Zoning Regulations are repealed.

COMING INTO FORCE

8. These Regulations come into force on the day on which the requirements set out in subsection 5.6(2) of the Aeronautics Act are met.

SCHEDULE
(Subsection 1(1) and section 2)

In this schedule, all grid coordinates are in metres (m) and refer to the 1983 North America Datum (GRS80 Ellipsoid, 1989 adjustment), Zone 17, Universal Transverse Mercator (UTM) projection. Grid coordinates have been computed using a combined average scale factor of 0.9995876.

In this schedule, all elevation values are in metres (m) and refer to the Canadian Geodetic Vertical Datum – CGVD28, 1978 Adjustment.

PART 1

DESCRIPTION OF THE AIRPORT REFERENCE POINT

The airport reference point, shown on Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheet 15, dated April 30, 2003, is a point that may be located by:

commencing at a point referred to as threshold 25, having grid coordinates of 551 298.78 E and 4 812 764.72 N, located on the centreline and at the eastern end of runway 07-25;

thence westerly along the centreline of runway 07-25, a distance of 1 341.15 m to a point;

thence southerly and perpendicular to the centreline of runway 07-25, a distance of 50.00 m to the airport reference point, having grid coordinates of 550 107.96 E and 4 812 146.94 N.

PART 2

DESCRIPTION OF THE TAKE-OFF/APPROACH SURFACES

The elevation of a take-off/approach surface at any point is equal to the elevation of the nearest point on the centreline of that take-off/approach surface.

The elevation of a take-off/approach surface centreline is calculated from the elevation of the end of the abutting strip surface and increasing at a constant ratio as provided in this Part.

The take-off/approach surfaces, shown on Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheets 1 to 27, dated April 30, 2003, are surfaces abutting each end of the strip surfaces associated with runways 07-25 and 14-32, and are described as follows:

(a) the take-off/approach surface abutting the 07 end of the strip surface associated with runway 07-25, consisting of an inclined surface having a ratio of 1.000 m measured vertically to 50.000 m measured horizontally, rising to the outer edge of the take-off/approach surface drawn at right angles to the projected centreline of the strip surface and distant 15 000.000 m measured horizontally from the end of the strip surface; the outer edge having a length of 2 400.000 m on either side of the projected centreline and an elevation being 300.000 m above the elevation at the end of the strip surface;

(b) the take-off/approach surface abutting the 25 end of the strip surface associated with runway 07-25, consisting of an inclined surface having a ratio of 1.000 m measured vertically to 50.000 m measured horizontally, rising to the outer edge of the take-off/approach surface drawn at right angles to the projected centreline of the strip surface and distant 15 000.000 m measured horizontally from the end of the strip surface; the outer edge having a length of 2 400.000 m on either side of the projected centreline and an elevation being 300.000 m above the elevation at the end of the strip surface;

(c) the take-off/approach surface abutting the 14 end of the strip surface associated with runway 14-32, consisting of an inclined surface having a ratio of 1.000 m measured vertically to 50.000 m measured horizontally, rising to the outer edge of the take-off/approach surface drawn at right angles to the projected centreline of the strip surface and distant 3 000.000 m measured horizontally from the end of the strip surface; the outer edge having a length of 600.000 m on either side of the projected centreline and an elevation being 60.000 m above the elevation at the end of the strip surface;

(d) the take-off/approach surface abutting the 32 end of the strip surface associated with runway 14-32, consisting of an inclined surface having a ratio of 1.000 m measured vertically to 50.000 m measured horizontally, rising to the outer edge of the take-off/approach surface drawn at right angles to the projected centreline of the strip surface and distant 3 000.000 m measured horizontally from the end of the strip surface; the outer edge having a length of 600.000 m on either side of the projected centreline and an elevation being 60.000 m above the elevation at the end of the strip surface.

PART 3

DESCRIPTION OF THE OUTER SURFACE

The outer surface, shown on Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheets 07, 08, 09, 14, 15, 16, 20, 21 and 22, dated April 30, 2003 is an imaginary surface established at a constant elevation of 45.000 m above the assigned elevation of the airport reference point except that, where that surface is less than 9.000 m above the surface of the ground, the outer surface is located at 9.000 m above the surface of the ground. The boundary of the outer surface is described as follows:

All those lands situate in the geographic Township of Waterloo, now in the Township of Woolwich, in the geographic Township of Waterloo, now in the City of Cambridge and in the geographic Township of Waterloo, now in the City of Kitchener, all in the Regional Municipality of Waterloo and described as follows:

commencing at the northeast corner of Lot 105, German Company Tract, in the geographic Township of Waterloo, now in the Township of Woolwich (see Sheet 08);

thence southerly along the eastern limit of Lot 105 to the northwest corner of Lot 86, German Company Tract, in the geographic Township of Waterloo, now in the Township of Woolwich (see Sheet 08);

thence easterly along the northern limit of Lot 86 to the northeast corner of Lot 86, German Company Tract, in the geographic Township of Waterloo, now in the Township of Woolwich, Regional Municipality of Waterloo (see Sheet 09);

PART 4

DESCRIPTION OF THE STRIP SURFACES

The elevation of a strip surface at any point is equal to the elevation of the nearest point on the centreline of that strip surface.

The elevation of the strip surface centreline between the strip surface end and the closest strip surface threshold is equal to the elevation of the strip surface end. The elevation of the strip surface centreline between the strip surface thresholds is calculated using a constant ratio between the elevations of the strip surface thresholds or points along the runway centreline as provided herein.

The strip surfaces, shown on Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheet 15, dated April 30, 2003, are described as follows:

(a) the strip surface associated with runway 07-25 is 300.000 m in total width, being 150.000 m on either side of the centreline of the runway. The strip surface commences 60.000 m to the west of threshold 07 and ends 60.000 m to the east of threshold 25, having a total length of 2 253.600 m. The 07 end of the strip surface has an elevation of 311.700 m and the 25 end of the strip surface has an elevation of 321.500 m. The azimuth of the centreline from threshold 07 to threshold 25 is 64°42'56". Threshold 07 has the grid coordinates of 549 370.38 E and 4 811 853.80 N and threshold 25 has the grid coordinates of 551 298.78 E and 4 812 764.72 N. The points between thresholds along runway 07-25 that control the elevation of the runway centreline are:

(b) the strip surface associated with runway 14-32 is 300.000 m in total width, being 150.000 m on either side of the centreline of the runway. The strip surface commences 60.000 m to the northwest of threshold 14 and ends 60.000 m to the southeast of threshold 32, having a total length of 1 370.360 m. The 14 end of the strip surface has an elevation of 313.000 m and the 32 end of the strip surface has an elevation of 312.500 m. The azimuth of the centreline from threshold 14 to threshold 32 is 127°59'51". Threshold 14 has the grid coordinates of 549 214.88 E and 4 812 357.07 N and threshold 32 has the grid coordinates of 550 199.80 E and 4 811 587.63 N. The points between thresholds along runway 14-32 that control the elevation of the runway centreline are:

PART 5

DESCRIPTION OF THE TRANSITIONAL SURFACES

The elevation of a point on the lower edge of a transitional surface abutting a strip surface is equal to the elevation of the nearest point on the centreline of the abutting strip surface.

The elevation of a point on the lower edge of a transitional surface abutting a take-off/approach surface is equal to the elevation of the nearest point on the centreline of the abutting take-off/ approach surface.

The transitional surfaces, shown on Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheets 07, 08, 09, 14, 15, 16, 20, 21 and 22, dated April 30, 2003, are imaginary inclined surfaces that extend upward and outward from the lateral limits of the abutting strip surface and the abutting take-off/approach surface rising at a ratio of 1.000 m measured vertically to 7.000 m measured horizontally and perpendicularly to the centreline of each strip surface and take-off/approach surface, to an intersection with the outer surface or with the transitional surface of an adjoining strip.

The bird hazard zone, shown on the Waterloo Regional Airport Zoning Plan No. 30-035 02-020, Sheets 07, 08, 09, 14, 15, 16, 20, 21 and 22, dated April 30, 2003, applies to all lands, including public road allowances, adjacent to or in the vicinity of the airport. The boundary of the bird hazard zone is described as follows:
