PREAMBLE |
|
In Call for
Applications to Provide an All Channel Alert1 (ACA2)
Service, Broadcasting Public Notice CRTC 2005-38, 22 April 2005, the
Commission announced that it had received an application for authority
to provide an All Channel Alert (ACA) service to broadcasting
distribution undertakings (BDUs) across Canada. In view of the nature,
scope and national implications of the proposal, the Commission called
for competing applications. In response to the call, two other
applications were received. |
|
The specifics of
the applications by Pelmorex Communications Inc., Canadian Broadcasting
Corporation (CBC) and Bell ExpressVu Limited Partnership are set out
below. |
|
The Commission
notes that the three applications for alert services are not technically
mutually exclusive. |
|
The Commission
intends to consider, subject to interventions, items 4 to 57 during the
non-appearance phase of the public hearing. |

2004-1260-2 |
|
Application by
Pelmorex Communications Inc. (Pelmorex) to amend its licence for The
Weather Network/MétéoMédia to provide an ALL CHANNEL ALERT3
(ACA4) service to broadcasting distribution undertakings (BDUs)
across Canada. If approved, the service would broadcast alerts and
messages related to imminent or unexpected threats to life or property
caused by severe weather disturbances, natural disasters or other
emergencies in local, regional and national areas of Canada for
distribution on the licensee’s services and on the other channels
offered by BDUs that distribute the licensee’s services. |
|
These alerts would
be broadcast on behalf of authorized federal government agencies, such
as Environment Canada, as well as the appropriate provincial and
territorial bodies. Television viewers in the areas affected would
receive the local alerts regardless of which channel they are watching. |
|
To implement this
proposal, Pelmorex is proposing to replace The Weather Network/MétéoMédia’s
current conditions of licence 1(a), 3(a) and 5, with the following (the
revised COLs are noted in italics): |
|
1. (a) The programming provided by the licensee shall be
dedicated exclusively to video programming, text and graphics
related to:
|
|
(i) meteorological, atmospheric and marine conditions for local,
regional and national areas of Canada, and international areas as
they may be of national interest to Canadians, as well as
programming relating to the prevention and effects of these
conditions; and
|
|
(ii) alerts and messages related to imminent or unexpected
threats to life or property caused by severe weather disturbances,
natural disasters or other emergencies in local, regional and
national areas of Canada for distribution on the licensee’s services
and on the other channels of broadcasting distribution undertakings
which distribute the licensee’s services.
|
|
3. In accordance with the Commission’s position on Canadian programming
expenditures as set out in Public Notices CRTC 1993-93
and 1993-174,
|
|
a) the licensee shall, in each broadcast year of the licence
term, expend not less than 37% of its gross revenue (Canadian
subscription and advertising revenues) of the previous year,
derived from that portion of the service described in condition of
licence 1(a)(i), on the investment in and/or acquisition of
Canadian programs.
|
|
5. For the duration of licence term, the licensee shall charge:
|
|
(a) each exhibitor of the portion of the service described in
condition of licence 1(a), a maximum wholesale rate of $0.23 per
subscriber per month, where the service is distributed as part of
the basic service; and
|
|
(b) each distributor of the complete service described in
conditions of licence 1(a) and 1(b), an additional wholesale rate of
$0.08 per subscriber per month, provided that the licensee has (i)
sent the exhibitor written notice of its intention to provide the
complete service as described in conditions of licence 1(a) and 1(b)
at least 180 days before the charge is made, or (ii) launched
that portion of the service described in condition of licence 1(b)
on the exhibitor’s undertaking.
|
|
The licensee
further stated that, in the event the Commission wishes to apply the
expenditure requirement to ACA revenues (i.e. the Commission does not
approve the revision to condition of licence number 3 above), then
Pelmorex requests that its wholesale fee be increased by $0.13 to a
total of $0.36 per month. |
|
Pelmorex is also
requesting that the Commission issue a distribution order pursuant to
paragraph 9(1)(h) of the Broadcasting Act. The distribution order
would include the following three elements: |
|
A requirement that each Class 1 and direct-to-home (DTH)
distribution undertaking distribute the ACA portion of The Weather
Network/MétéoMédia when the service is made available to it by
Pelmorex;
|
|
an authorization for all undertakings to alter the programming
services distributed on its undertaking in order to insert an ACA
emergency message provided by Pelmorex; and
|
|
an authorization for each Class 1 distribution undertaking that
has its basic rate regulated in accordance with Part 5 of the
Broadcasting Distribution Regulations to increase its basic
monthly fee by an amount necessary to off-set the pass-through
portion of that fee that is attributable to the distribution of ACA.
|
|
Under the proposed
order, all Class 1 BDUs, including multipoint distribution services
(MDS), and DTH BDUs would be required to distribute the ACA service when
it is made available to them by Pelmorex. The distribution of the ACA
component of The Weather Network/MétéoMédia would be optional for
Class 2 and Class 3 systems, as well as for licence exempt systems. |

Application by the
Canadian Broadcasting Corporation (CBC) to provide an all-hazard,
all-channel emergency broadcasting public alert service. |
|
According to the
applicant, authorized alerting organizations would be responsible for
encoding alert messages in a standard format based on specific
informational and technical protocols. These organizations would include
Environment Canada, the RCMP and Provincial Emergency Organizations (EMOs).
The CBC would not exercise any control over the issuance, content or
frequency of public alerts. |
|
These emergency
alert messages would be delivered to CBC’s National Alarm Centre in
Ottawa and then uplinked for satellite distribution to the CBC’s entire
radio transmission backbone. Emergency Alert System (EAS) decoders at
the transmitter sites would decode the standardized alert messages and
broadcast them if the message is relevant to the geographic area served
by the radio transmitter. |
|
The CBC will seek
the funding for this system directly from the Government of Canada
through Industry Canada’s recently approved CANALERT initiative, a
national emergency public alerting strategy and system. |
|
The applicant has
requested that the Commission amend section 7(d) of the Broadcasting
Distribution Regulations to permit BDUs to distribute the emergency
alerts once a BDU has entered into an agreement with an alert provider. |
|
Under the
applicant’s proposal, section 7(d) of the Broadcasting Distribution
Regulations currently states: |
|
7. A licensee shall not alter or delete a programming service in
a licensed area in the course of its distribution except
|
|
(d) for the purpose of altering a programming service to insert
an emergency alert message in accordance with an agreement entered
into with the operator of the service or the network responsible for
the service;
|
|
Section 7(d)
would be revised as follows: |
|
7. A licensee shall not alter or delete a programming service in
a licensed area in the course of its distribution except
|
|
(d) for the purpose of transmitting an authorized emergency
public alert message;
|
|
Cable and DTH
operators could voluntarily participate in this system by introducing
EAS decoders at their headends and, subject to the amendment to the
Broadcasting Distribution Regulations being sought in this
application, switch all channels distributed on their undertakings to
the alert message. |
|

Limited Partnership (ExpressVu) for authorization to provide an all
channel emergency alerting service. |

According to the
applicant, notification of imminent threats to public safety would be
received by ExpressVu either directly from CANALERT when it becomes
fully operational within the next five years, from CANALERT via an
authorized third-party emergency alert service provider, or directly
from a third-party service provider. ExpressVu would then insert the
alert over the in-progress programming of all television programs and
services it distributes. The alert message would take the form of
bilingual alphanumeric crawls and audio warnings in either a national or
geographically focused dispersal pattern as the situation demands. |
|
The applicant
states that, in funding its emergency alert service, no monthly fees
would be imposed upon ExpressVu’s subscribers. |
|
ExpressVu has also
applied for a condition of licence to its DTH broadcasting distribution
licence, relieving it of the obligation set out in Section 7(d) of the
Broadcasting Distribution Regulations to obtain the agreement of
the operator of a programming service or the network responsible for the
service prior to inserting an emergency alert message into the
programming service. |

service |

To increase the age
of its target audience by adding youths between 15 and 17 years of age. |

The new condition
of licence would read as follows: |

The programming provided by the licensee shall have as its target
audience only children and youths up to 17 years of age.
|
|
Advertising |
|
To eliminate the
restriction on the broadcast of advertising material and allow VRAK.TV
to distribute not more than 12 minutes of national advertising material
during each clock hour. |
|
Indexing of
wholesale rates |
|
If the amendments
requested concerning the distribution of advertising material are
approved, VRAK.TV will consequently waive the partial indexing mechanism
of its monthly wholesale rate set out in its current condition of
licence, which calls for an annual increase of the maximum wholesale
rate of the service equal to the consumer price index (CPI) less 2%. |
|
The new condition
of licence would read as follows: |
|
Effective 1 September 2006, and for each subsequent year of its
licence term, the licensee shall charge each exhibitor of this
service a maximum wholesale rate of $0.60 per subscriber per month
for exhibition on the basic service.

Canadian
programming expenditures |
|
The licensee
proposes to increase, from 35% to 41%, the percentage of the service’s
gross operating revenue of the previous year that is to be devoted to
Canadian programming expenditures. |

proposes to replace the following condition of licence relating to the
percentage of its programming distributed on YTV to its target audience: |

1) In each broadcast year, a minimum of 30% of the programming
distributed on YTV shall have as its target audience children up to
5 years of age, a minimum of 48% shall have as its target audience
children and youth 6 to 17 years of age, and a maximum of 22% shall
have as its target audience families.
|
|
with the following
condition: |

1) In each broadcast year, a minimum of 70% of the programming
distributed on YTV shall have as its target audience children and
youth up to 17 years of age and a maximum of 30% shall have as its
target audience youth and their families.
|
|
The licensee also
proposes to delete the following conditions of licence: |

2) The licensee shall devote 100% of the programs in the drama
category distributed in the period between 6 p.m. and 9 p.m. in the
evening broadcast period to programs with a major protagonist who is
a child, youth under the age of 18 years, puppet, animated
character, creature of the animal kingdom, comic book character,
folk and/or super hero or classical or historical hero.

|
3) The licensee shall provide programming of particular interest
to youth (age 12-17) and their families during the period from 9
p.m. to midnight.
|
|
6) The licensee shall devote no more than an average of one hour
per evening broadcast period over each broadcast week to drama
programs produced in any one country other than Canada, excluding
feature films and specials.
|
|
7(2) In any seven-day period of Sunday to Saturday, in the
evening broadcast period, the licensee shall distribute no more than
two feature films.
|
|
10) In each broadcast year, the licensee shall devote a minimum
of 35% of its non-Canadian programming to programs from non-North
American sources.

test;

iii) where music occurs in a film, and is not used as
background music for synchronized spoken word, the duration of
such music will be counted as music for purposes of the 60:40
test;

iv) where music occurs within a film and small amounts of
non-synchronized dialogue are present within such music, the
duration of such music will be counted as music for purposes of
the 60:40 test.

programming in Korean, Japanese, Vietnamese and other East-Asian
languages. |

The applicant
proposes to offer programming from the following categories: 2(b), 7(c),
7(d), 8(a), 9, 11, 12, 13 and 14 as set out in Schedule I of the
Specialty Services Regulations, 1990. |

programs, cooking, music and dance. |

proposes to offer programming from the following categories: 1, 2(a),
