How can I find out whether someone is bankrupt?
The Office of the Superintendent of Bankruptcy runs an insolvency name search service. By
contacting that service and paying a fee, you can find out whether a person has begun insolvency proceedings. The service is available on the Internet on the OSB's Website at
https://strategis.ic.gc.ca/sc_mrksv/bankruptcy/bankruptcySearch/engdoc/ or by calling 613- 941-2863.
As a creditor, how can I ensure that the trustee administers the bankruptcy or proposal in accordance with the Act's provision?
At the first creditors' meeting, as a result of the creditors' vote, you might be appointed as an inspector. As an inspector you will represent the creditors before the trustee. You will also be entitled to assist the trustee during the administration of the proposal or the bankruptcy. For example, you will have to approve reports and statements prepared by the trustee during the administration.
I am a creditor in a bankruptcy. I have a reason to believe that the bankrupt has acted contrary to the law. What action can I take?
You should contact the trustee handling the bankruptcy. The trustee must be informed on what the bankrupt has done. You can also contact the Office of the Superintendent of Bankruptcy in your area. An employee of the Office of the Superintendent may interrogate the bankrupt if it's considered appropriate.
