REPORT ON THE ADMINISTRATION
OF THE YUKON EDUCATION
STAFF RELATIONS ACT

FOR THE FISCAL YEAR ENDING
MARCH 31, 2005

INTRODUCTION

            The Act to Amend the Education Staff Relations Act and the Public Service Staff Relations Act (assented to on December 14, 2004) established a new Education Labour Relations Act (the "new Act") and a new Yukon Teachers Labour Relations Board (the "new Board"). The new Act came into force on April 1, 2005 and the new Board came into existence on that same date, to be considered as a continuation of the former Board. Pursuant to transitional provisions in the amending Act, any proceeding that the former Board was seized of before that date was transferred to the new Board.

          During the year under review, two references to adjudication dealing with policy grievances related to the staffing protocol were carried over from the previous year.

            No new references to adjudication were received for the year under review.

GRIEVANCES/ADJUDICATION

          The Board dealt with two (2) cases (369-YG-4 and 369-YG-5) during the year in review.  Both cases have to do with policy grievances pertaining to staffing protocol.

            One case (369-YG-4) was withdrawn by the bargaining agent prior to the hearing.

            The other case (369-YG-5) was settled by the parties prior to the hearing.
