Compensation Program for Federal Penitentiary Inmates

Description:

If, while serving a sentence in a federal penitentiary, an inmate is injured as a result of an accident, while participating in an approved program, i.e. work activities or training program, the inmate may be entitled to benefits similar to workers' compensation.

An inmate who is injured as a result of an accident must report the incident to the Correctional Services Canada within three months of the occurrence and submit an application for compensation to Human Resources and Social Development Canada - Labour, before his/her release from the institution on full parole, on statutory release or before the expiration of a sentence.

The benefits payable are the costs of medical care and a monthly or lump sum disability payment. The amount awarded reflects the degree of disability remaining after the inmate is released. Payments are made only after an inmate is released from the penitentiary on statutory release, on full parole or upon the expiration of a sentence.   An inmate may also be eligible to receive benefits while on day parole if he/she is employed on a full-time basis by someone other than Correctional Service Canada.

In the case of an accident-related death, benefits are payable to qualifying dependants.
