After Marriage Breakdown
Information on the On-reserve Matrimonial Home
This booklet explains which partner, after a marriage or common-law relationship ends, has the right to possess the matrimonial (family) home on a reserve, particularly if the reserve has a housing shortage. It gives legal information to address specific concerns: that possession of the matrimonial home is influenced by unequal rights and protections on and off reserves; the existence of a bias in favour of men; and when family violence is a factor. Lists some other sources of information.
