Compensation

There are a number of hepatitis C compensation plans available depending upon the year a person was infected through the blood system.

Pre-86/Post-90 Hepatitis C Class Action Settlement

On June 8, 2007, the Pre-1986/Post-1990 Hepatitis C Class Action Settlement Agreement was approved by the courts as being fair and reasonable and in the best interests of the class. The courts also selected Crawford Class Actions Services as the administrator of the compensation fund. Crawford will operate as an independent third party at arm's length from the federal government, and as a result, the Government of Canada does not have control over the timing of the remaining steps. The administrator established procedures to receive and review applications and provide compensation payments to approved applicants. On August 10, 2007 the compensation plan was implemented. Information on how to apply for compensation may be obtained by contacting the administrator toll-free at 1-866-334-3361, by e-mail at preposthepc@crawco.ca or by going to the Crawford websitenew window. One of the roles of the administrator is to assist the applicant through all phases of the application process. Provincial compensation plans

Some provinces have acted alone and have chosen to provide compensation for individuals infected with hepatitis C pre-1986 and post-1990. British Columbia, Manitoba, Ontario et Quebec each provide a provincial compensation plan.

British Columbia

A settlement has also been reached with the Province of British Columbia for persons who were infected with the hepatitis C virus as a result of tainted blood received in British Columbia prior to 1986 and between July 1, 1990 and September 28, 1998 inclusive. KPMG Inc. has also been appointed claims administrator pursuant to this particular settlement. A person who is a primarily infected claimant, is approved for the Red Cross Plan of Compromise and Arrangement and establishes that his or her claim arises from blood received in British Columbia will automatically qualify for additional payments from the $6.5 million fund created by British Columbia. Manitoba

On January 18, 2001, the Government of Manitoba announced a compensation program for Manitobans infected with hepatitis C through the Canadian blood supply before 1986 and after 1990. The Manitoba Hepatitis C Assistance Package (MHCAP)  new window consists of a one-time payment of $10,000 from the Manitoba government. To obtain an application package, assistance in filling out the application, or for more information regarding MHCAP, the public may call 204-788-6339 (in Winnipeg) or toll-free 1-866-357-0196.

Ontario

Under the Ontario Hepatitis C Assistance Plan (OHCAP)  new window, the Ontario government has decided to provide a one-time payment to individuals who contracted hepatitis C through the blood system in Ontario, or to individuals who were infected with HCV by a spouse, partner or parent who received blood or blood products in Ontario, before January 1, 1986, or between July 2, 1990 to September 28, 1998. Quebec

Assistance is available under the Quebec Financial Assistance Program to individuals who contracted hepatitis C as a direct result of a blood transfusion in Quebec or the administration of blood products in Quebec. Individuals indirectly infected from a spouse, father or mother who contracted the disease as a result of a blood transfusion in Quebec or administration of blood products in Quebec may also be eligible for compensation. Individuals must have been infected either before January 1, 1986 or after July 1, 1990, but before September 28, 1998 to be eligible. 3. Red Cross Plan of Compromise and Arrangement

Compensation for individuals infected with hepatitis C through the blood system outside of the 1986-1990 period may become available through the Plan of Compromise and Arrangement put forth by the Red Cross and approved by Red Cross creditors on August 30, 2000.
