Problem: The above noted models of the Evenflo Titan combination infant and child restraint system bear two statement of compliance labels that have conflicting information regarding the recommended weight range for an infant when the restraint system is used in the rear facing mode.  The large white and yellow label on the side of the unit indicates a weight range for infants from 2.3 - 13.6 kg (5-30 lbs).  A second large white label affixed under the unit on the inner side indicates a more restrictive weight range of 2.3-10 kg (5-22 lbs).  The instruction manual accompanying the restraint system correctly states the upper weight limit for the unit as 13.6 kg (30 lbs).  The conflicting information associated with these two labels may be confusing to consumers and may result in some consumers not benefiting from the full weight range that the restraint system is designed and certified to carry under the applicable safety standard.
 
Background: As part of its enforcement testing program, Transport Canada personnel purchased a representative Evenflo Titan model for compliance inspection and testing purposes.  During an examination of the restraint system in question, the ambiguous labels were identified.  Evenflo was contacted and immediately conducted an investigation into the matter and confirmed the error to Transport Canada.  Evenflo cooperated with Transport Canada and assisted in providing the information for this notice.

Safety Risk: Transport Canada concurs with the manufacturer’s position that the understated weight limit does not constitute a non-compliance condition nor a safety-related defect with the unit.  When the unit is used as intended by the manufacturer, in the rearward facing mode by an infant under the maximum upper weight limit of 13.6 kg (30 lbs), the unit meets the applicable safety performance requirements.
   
Company Action: Evenflo has taken immediate corrective action to introduce a revised white label for production of the restraint system.  In addition, Evenflo is making available this revised white label and accompanying instruction sheet to retailers and affected consumers. The new revised white label is to be affixed over the old label.
   
Consumer Recourse: Consumers with one of these models can call the Evenflo Parent Link Consumer Resource Centre toll-free at 1-800-233-5921.  They will receive a new label in the mail at no cost.  A caller should have the Evenflo Titan Model Number and date of manufacture ready when they call the Evenflo customer service line.  The model name, model number and date of manufacturer is printed on the label which is affixed to the back of the restraint system.
