Issue:
It was reported to Transport Canada that Baby Zone in Victoria, B.C. was
importing infant restraint systems from the United States that did not comply
with Canada Motor Vehicle Safety Standard 213.1 – Infant Restraints.
Background and Company Action:
A consumer in Victoria, B.C. purchased one of the travel systems manufactured
by Baby Trend and proceeded to a car seat clinic for an installation check. She
was informed by the technician that the infant restraint did not comply with the
applicable Canada Motor Vehicle Safety Standards. These infant restraints have
not been dynamically tested to the Canadian requirement and therefore do not
bear the National Safety Mark (circular label with a maple leaf in the centre)
that indicates compliance.
The technician reported the incident to the Transport Canada team in
Vancouver who contacted the importer, Baby Zone, to request that they remove the
product from the shelf.
The importer, Baby Zone, had imported five units into Canada; three stroller
units and two jogger units. The three stroller units have been sold.
Consumer Recourse:
Transport Canada cannot comment as to the performance of these restraints in
the event of a motor vehicle collision. In addition, the use of these restraints
in a motor vehicle would be considered contrary to the provincial highway
regulations. The three stroller units that have been sold do not comply with the
Canadian standards and therefore are illegal for use in a vehicle in Canada. It
is recommended that the owners of these units contact the importer to exchange
them for complying units or for in-store credits.
