Welcome to the National Film Board of Canada Web site (the "NFB" and the "Site").

By accessing this Site, whether you are a home video user/purchaser or an institutional user/purchaser, you agree, without limitation, to our general conditions of use and sale.

Conditions of use of the NFB Site

Intellectual property rights

The NFB Web Site, and the content of the Site, are protected by intellectual property laws and other legislation applicable in Canada and around the world. It contains exclusive materials, which are protected by property rights, copyrights, patents, trade secrets, trade-marks, personality rights, etc.

We grant you the non-exclusive right to access this site for personal use by means of your personal computer, without any further right of reproduction. You may browse the Site, download and store certain materials in your personal computer and copy excerpts solely for your own personal use.

When downloading, storing or reproducing materials from this Site, you must always include all copyright and ownership notices and trade-marks appearing on the materials.

In deciding to use this Site, you agree to the following conditions:

  1. You may not broadcast, rent, sell, alter or redistribute the content of this Site, in whole or in part, or use it in any other way for financial or commercial gain without the prior written consent of the NFB.

Registering and opening an account

By completing your registration application, you declare that you are authorized to open an account, that you understand these terms and conditions and that you agree to be bound by them.

To open an account, you must provide complete and accurate information. You must then choose a password. You assume full responsibility for protecting the confidentiality of your user account and your password. You also assume full responsibility for all transactions carried out using your account.

You agree to notify the NFB immediately of any unauthorized use of your account or password.

If you are an institutional user, you declare that any person who uses your account and your password is a person authorized to place orders for our products.

Security and privacy policy

The NFB guarantees the security of your credit card payments by our use of data encryption and the industry-standard SSL (Secure Socket Layer) secure payment method.

The NFB has further adopted a Privacy Policy to protect your personal information (name, address, e-mail address and any other identifying information), which you may read by clicking Privacy & Security.

Limitation of liability

Although we make every reasonable effort to ensure that the information presented on this Site is accurate and up to date, the Site could still contain possible errors or inaccuracies. We make no express warranty in this regard and urge you to double-check all information before using it.

In no event shall the NFB be liable for direct or indirect damages arising from the content or use of any site other than its own, regardless or whether such site is linked to this site.

Nor shall the NFB be liable for the content or use of materials from third parties which are contributed to this Site by those third parties, (e.g. in discussion forums) or otherwise mentioned on this Site.

Governing legislation

The NFB is an agent of the federal Crown which operates this Site from servers located within Canada. The Site is designed to comply with the laws that apply in Canada.

Conditions of sale of NFB products

Online Stores

Home Video Store: these products are offered only to the general public, and are available solely for private home viewing.

NFB Resources Shop: these products are offered only to educational institutions, government agencies, businesses, band councils, social service agencies, and professional, religious or cultural organizations or libraries for representation to the public free of charge.

Intellectual property rights

Whether you are a home video or institutional purchaser, you agree to comply with all copyright, trade-mark or intellectual property notices appearing on our products. In particular:

a) Any form of reproduction, in whole or in part, by any method now known or not yet known, is strictly prohibited without prior written authorization from the NFB;

b) You may not rent, sell, alter or redistribute our products, in whole or in part, or use them in any other way for financial or commercial gain.

If you are a home video purchaser, you may not use our products for public representation or transmission.

If you are an institutional purchaser and you wish to use any of our products on a network, you must contact our Sales and Customer Service to obtain prior written authorization from the NFB.

Availability of products

The NFB does not guarantee that all films offered for sale are available in both English and French versions. The NFB offers its products only in the versions that are available and that already exist.

The NFB does not guarantee that the catalogues of products offered in the two Stores (Home Video Store and NFB Resources Shop) are identical.

Films are available in NTSC VHS videocassette format (for North America).

Territory of sale

The NFB offers its products for sale only within Canada.

Prices

The prices to be paid are the prices shown for the products, and vary by category of purchaser (home video or institutional).

The applicable sales taxes are not included in the prices shown. Shipping and delivery charges and the sales taxes applicable to these materials are extra.

The prices for products offered on this Site may be different from prices offered at other authorized points of sale.

The NFB reserves the right to change the prices of the products offered on this Site at any time and without notice.

Paying for your orders

Home Video orders: We accept VISA, MasterCard and American Express. If you wish to place your order by telephone, or to send us your personal credit card information by fax and then complete the order by telephone, you may do so by contacting Sales and Customer Service.

Institutional orders: These orders must be paid for by VISA, MasterCard or American Express. Customers who already have a pre-approved account may pay their accounts by purchase order. For more information regarding this option, please contact Sales and Customer Service.

Product deliveries

The NFB will deliver products that are ordered to the address in Canada that you indicate when you place the order. Delivery time for items in inventory is about one week, or two to three weeks for articles that are not available in inventory. The Canada Post delivery times mentioned above are in addition to these estimates. If you need further information regarding delivery of your order, please contact Sales and Customer Service.

Product returns

Our guarantee is simple. If you are not completely satisfied with the quality of the product you have purchased, you may return it to us within 30 days of the date of delivery. Before returning a product, however, please contact Sales and Customer Service to obtain a Return Materials Authorization (RMA), which must appear on your return. Some restrictions may apply. Please include a copy of the packing slip with your return. Products should be returned to the following address:

General

Force majeure

In the event of circumstances beyond our control or force majeure, the NFB will not be liable for failure to perform any of its obligations to you, in whole or in part, or for any damage or loss you may suffer.

Modifications to legal conditions

The NFB reserves the right to modify the content of these legal conditions at any time and it is your responsibility to consult the legal conditions on a regular basis to determine whether any modifications have been made.

If you are not willing to agree to the rules in these legal conditions, we request that you not use this Site.

If you are under 18 years of age, your parents or legal guardians must also agree to these rules.
