To All to Whom these Presents shall come or whom the same may in anyway concern,--Greeting:

A PROCLAMATION

Whereas in and by section 21 of the Navigable Waters Protection Act, being chapter N-19 of the Revised Statutes of Canada, 1970, it is provided that the Governor in Council, when it is shown to his satisfaction that the public interest would not be injuriously affected thereby, may, by proclamation, declare any rivers, streams or waters referred to in sections 19 and 20 of the said Act, or any part or parts thereof, exempt in whole or in part from the operation of those sections;

And Whereas an application has been received from Ontario Hydro for permission to dispose of ash and construct a railway access route in the Lower Basin, Atikokan Generating Station, Township of Schwenger, District of Rainy River, Province of Ontario;

And Whereas it has been shown to the satisfaction of His Excellency the Governor General in Council that the public interest would not be injuriously affected by reason of the action proposed in the said application.

Now Know You that We, by and with the advice of Our Privy Council for Canada, do by this Our Proclamation declare the Lower Basin, Atikokan Generating Station, Township of Schwenger, District of Rainy River, Province of Ontario to be an area which is exempt from the operation of sections 19 and 20 of the Navigable Waters Protection Act, being an area for the disposal of ash and the construction of a railway access route as shown on Plans 8502-DXE-13200-0200 and 8502-DOH-27951-0001, Rev. 01, deposited in the Department of Transport.

Of All Which Our Loving Subjects and all others whom these Presents may concern are hereby required to take notice and to govern themselves accordingly.

In Testimony Whereof, We have caused these Our Letters to be made Patent and the Great Seal of Canada to be hereunto affixed. Witness: Our Right Trusty and Well-beloved Edward Richard Schreyer, Chancellor and Principal Companion of Our Order of Canada, Chancellor and Commander of Our Order of Military Merit upon whom We have conferred Our Canadian Forces' Decoration, Governor General and Commander-in-Chief of Canada.

At Our Government House, in Our City of Ottawa, this sixteenth day of January in the year of Our Lord one thousand nine hundred and eighty and in the twenty-eighth year of Our Reign.
