Regulations Amending the Regulations Respecting Applications for Permits for Disposal at Sea (Miscellaneous Program)

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The proposed Regulations Amending the Regulations Respecting Applications for Permits for Disposal at Sea (Miscellaneous Program) [hereinafter referred to as the proposed amendments] made pursuant to section 135 of the Canadian Environmental Protection Act, 1999 were developed to address recommendations made by the Standing Joint Committee for the Scrutiny of Regulations, specifically to achieve consistency between the English and French versions of the Regulations Respecting Applications for Permits for Disposal at Sea (hereinafter referred to as the Regulations). In addition, the proposed amendments would remove the list of regional Disposal at Sea Program office addresses from the Regulations, thus removing addresses that have changed and that would instruct applicants to send applications to a wrong address. The addresses will instead be posted on Environment Canada's Disposal at Sea Program Web site and would allow for the list to be updated as necessary.

The proposed amendments would not change the intent or scope of the Regulations.

Proposed amendments

The proposed amendments would align the French and English version of the Regulations by replacing the words "NUMBER OF DOCUMENTS ATTACHED" in Box 19 of Part B of the schedule to the Regulations with the words "NUMBER OF PAGES ATTACHED". This amendment would ensure consistency with "NOMBRE DE PAGES JOINTES" in the French version of the Regulations.

In addition, the proposed amendments would remove the list of addresses at the end of the permit application form in the schedule to the Regulations. The addresses will be made available on Environment Canada's Disposal at Sea Program Web site at www. ec.gc.ca/seadisposal. This amendment would provide Environment Canada with greater flexibility to more quickly reflect address changes and make them available to regulated persons.

These proposed amendments would come into force on the day on which they are registered.

Alternatives

As the proposed amendments are administrative in nature and are developed to provide greater clarity and consistency to the Regulations, no other alternatives were considered.

Consultation

As the proposed amendments are administrative in nature, no formal stakeholder consultations were held.

PROPOSED REGULATORY TEXT

Notice is hereby given, pursuant to subsection 332(1) (see footnote a) of the Canadian Environmental Protection Act, 1999, (see footnote b) that the Minister of the Environment proposes, pursuant to subsection 135(3) (see footnote c) of that Act, to make the annexed Regulations Amending the Regulations Respecting Applications for Permits for Disposal at Sea (Miscellaneous Program).

Any person may, within 60 days after the date of publication of this notice, file with the Minister of the Environment comments with respect to the proposed Regulations or a notice of objection requesting that a board of review be established under section 333 of that Act and stating the reasons for the objection. All comments and notices must cite the Canada Gazette, Part I, and the date of publication of this notice, and be addressed to Linda Porebski, Chief, Marine Environmental Protection Programs Section, Compliance Promotion and Permitting Division, Environmental Protection Operations Directorate, Environmental Stewardship Branch, Department of the Environment, Ottawa, Ontario K1A 0H3.

A person who provides information to the Minister of the Environment may submit with the information a request for confidentiality under section 313 of that Act.

REGULATIONS AMENDING THE REGULATIONS RESPECTING APPLICATIONS FOR PERMITS FOR DISPOSAL AT SEA (MISCELLANEOUS PROGRAM)

AMENDMENTS

1. Box 19 of Part B of the form entitled "PERMIT APPLICATION (DISPOSAL AT SEA)" set out in the schedule to the English version of the Regulations Respecting Applications for Permits for Disposal at Sea (see footnote 1) is amended by replacing the words "NUMBER OF DOCUMENTS ATTACHED" with the words "NUMBER OF PAGES ATTACHED".

2. The portion of the form entitled "PERMIT APPLICATION (DISPOSAL AT SEA)" set out in the schedule to the Regulations after the signature block and before Appendix 1 to the form is repealed.

COMING INTO FORCE

3. These Regulations come into force on the day on which they are registered.
