  Board of Referees

Boards of Referees Policy and Administration Pursuant to section 111 of the Employment Insurance Act and section 78 of the Regulations

3. AUTHORITY

3.1 Subsection 111(2) of the EI Act

"The chairperson of a Board of Referees shall be appointed by the Governor in Council for a renewable term of three years and may be removed at any time by the Governor in Council for cause."

3.2 Subsection 111(3) of the EI Act

"Panels of employers and their representatives and insured persons and their representatives shall be established by the Commission, and the members of the Boards of Referees shall be selected from those panels in the prescribed manner."

3.3 Appointment process

Following consultation with national, regional and/or local labour organizations, the Commissioner for Workers shall appoint insured persons' representatives to the Board of Referees for a term of up to three years which may be terminated at any time. Similarly, following consultation with various national, regional and/or local employer organizations, the Commissioner for Employers shall appoint employer representatives to the Board of Referees for a term of up to three years which may be terminated at any time.
