4. APPLICATION
4.4 Suspension from Board duties
4.4.1 Pending an Investigation
If HRSDC becomes aware of a possibility of, but not limited to, the following examples of investigations:
under the criminal code, involving a chairperson or panel member, or the company for which he/she works;
under the EI Act, involving the chairperson or panel member or the company for which he/she works;
under Sections 38, 39, 65.1, 135 or 136 of the EI Act (reference Appendix A);
the Service Canada director/manager (or other appropriate officials) shall immediately send a report with full details to the Regional Office, which shall in turn relay the information on an urgent basis to the Director, Appeals, National Headquarters. The Director, Appeals, will ask the respective appointing authority for an immediate decision with respect to the member. The decision will remain until the appointing authority decides otherwise.
If a guilty verdict is rendered by the Court, or if the decision under Sections 38, 39, 65.1, 135 or 136 of the EI Act is maintained, for example, the appropriate appointing authority shall be notified for a final decision on the matter.
