4. APPLICATION
4.5 Termination
4.5.1 Authority to terminate
In the case of chairpersons, the Minister may recommend to the Governor in Council that the appointment be terminated for cause.
The respective Commissioner may on behalf of the Commission terminate the appointment of a panel member.
4.5.2 Reasons for termination
The Service Canada manager will notify the Regional Office if there appears to be reasons to consider the termination of appointment of any chairperson or Board member. Some examples of reasons for termination are:
(1) Act of a criminal nature
If a chairperson or panel member is found guilty of an offense in relation to the Criminal Code, or in relation to the EI Act, or a decision was rendered against that individual under Sections 38, 39, 65.1, 135 or 136 of the EI legislation, the decision as to whether their appointment will be terminated will be made by the Governor in Council, in the case of chairpersons, or the respective Commissioner for panel members.
(2) Unacceptable behaviour
If the Service Canada director/manager (or other appropriate officials) becomes aware that a chairperson or panel member has made statements or behaved in a manner unbecoming to the dignity, decorum, confidentiality or responsibility of office, then the manager shall prepare a complete report to be forwarded to the respective appointing authority for an immediate decision.
