Mr. Regan (Halifax West), seconded by Mr. Szabo (Mississauga South), moved Motion No. 2, — That Bill C-284 be amended by restoring clause 1 as follows:
“1. The Canada Student Financial Assistance Act is amended by adding the following after section 14:
|
14.1 (1) The Minister, an appropriate authority or a body authorized by the Minister for a province, may make a Canada access grant to a qualifying student if the student
|
(a) has a permanent disability;
|
(b) meets the criteria set out in subsection 12(1); and
|
(c) is not denied further student loans under section 15 of the regulations.
|
(2) To receive a grant under this section, a qualifying student shall provide, with the loan application, proof of their permanent disability in the form of
|
(a) a medical certificate;
|
(b) a psycho-educational assessment; or
|
(c) documentation proving receipt of federal or provincial disability assistance.
|
(3) The amount of all grants made under this section to a qualifying student in a loan year shall not exceed the lesser of
|
(a) the qualifying student’s assessed need; and
|
14.2 (1) The Minister, an appropriate authority or a body authorized by the Minister for a province, may make a Canada access grant to a qualifying student if the student
|
(a) meets the criteria set out in subsection 12(1);
|
(b) is enrolled as a full-time student in a program of studies of at least two years that leads to a degree, certificate or diploma at a designated educational institution;
|
(c) first enrolled in that program within four years after leaving secondary school;
|
(d) has never previously been enrolled in a program of studies; and
|
(e) is a person in respect of whom a national child benefit supplement, or a special allowance under the Children’s Special Allowances Act, is payable or would be payable if the person was less than eighteen years of age.
|
(2) The amount of a grant made under this section to a qualifying student in a loan year shall not exceed the least of
|
(a) the qualifying student’s assessed need;
|
(b) 50% of the student’s tuition; and
|
(3) In this section, “national child benefit supplement” means that portion of a child tax benefit determined under the description of C in subsection 122.61(1) of the Income Tax Act.
|
14.3 (1) The Minister shall pay to the appropriate authority or other body authorized by the Minister for a province the amount the authority or other body requires to make Canada access grants to qualifying students for a loan year under section 14.1 or 14.2.
|
(2) Each appropriate authority or other body shall provide to the Minister at the end of each loan year, or on request of the Minister during a loan year, an accounting of all grants made to qualifying students by that appropriate authority or other body during that loan year or other period identified by the Minister.
|
(3) An appropriate authority or other body shall repay to the Minister any money provided for a loan year that is not given as grants in accordance with section 14.1 or 14.2. The overpayment becomes a debt due to Her Majesty in right of Canada on the day after the last day of that loan year.”

« 1. La Loi fédérale sur l’aide financière aux étudiants est modifiée par adjonction, après l’article 14, de ce qui suit :
|
SUBVENTIONS CANADIENNES D’ACCÈS
|
14.1 (1) Le ministre, l’autorité compétente ou l’entité autorisée par le ministre à agir pour une province peut octroyer une subvention canadienne d’accès à tout étudiant admissible qui répond aux conditions suivantes :
|
a) il a une invalidité permanente;
|
b) il satisfait aux critères énoncés au paragraphe 12(1);
|
c) il ne fait pas l’objet d’un refus de prêt d’études en vertu de l’article 15 du règlement.
|
(2) L’étudiant admissible doit, pour obtenir une subvention en vertu du présent article, joindre à sa demande de prêt une preuve de son invalidité permanente, sous l’une des formes suivantes :
|
a) un certificat médical;
|
b) une évaluation psychopédagogique;
|
c) un document attestant qu’il reçoit une allocation d’invalidité fédérale ou provinciale.
|
(3) Le montant maximal des subventions pouvant être octroyées à l’étudiant admissible en vertu du présent article est, pour chaque année de prêt, le moindre des montants suivants :
|
a) le montant auquel ses besoins ont été évalués;
|
14.2 (1) Le ministre, l’autorité compétente ou l’entité autorisée par le ministre à agir pour une province peut octroyer une subvention canadienne d’accès à tout étudiant admissible qui répond aux conditions suivantes :
|
a) il satisfait aux critères énoncés au paragraphe 12(1);
|
b) il s’est inscrit à temps plein à un programme d’études dans un établissement agréé dont la durée est d’au moins deux ans et qui mène à l’obtention d’un certificat ou d’un diplôme;
|
c) il s’est inscrit pour la première fois à ce programme dans les quatre années suivant la fin de ses études secondaires;
|
d) il n’a jamais été inscrit auparavant à un programme d’études;
|
e) un supplément de la prestation nationale pour enfants ou une allocation spéciale prévue par la Loi sur les allocations spéciales pour enfants est versé pour lui ou le serait, s’il avait moins de dix-huit ans.
|
(2) Le montant maximal de la subvention pouvant être octroyée à l’étudiant admissible en vertu du présent article est, pour chaque année de prêt, le moindre des montants suivants :
|
a) le montant auquel ses besoins sont évalués;
|
b) 50 % de ses droits de scolarité;
|
(3) Au présent article, « supplément de la prestation nationale pour enfants » s’entend de la portion de la prestation fiscale pour enfants déterminée selon l’élément C de la formule figurant au paragraphe 122.61(1) de la Loi de l’impôt sur le revenu.
|
14.3 (1) Le ministre verse, pour une année de prêt, à l’autorité compétente ou à l’entité autorisée par le ministre à agir pour la province les sommes nécessaires pour octroyer aux étudiants admissibles les subventions prévues par les articles 14.1 ou 14.2.
|
(2) À la fin de chaque année de prêt ou à la demande du ministre durant l’année de prêt, l’autorité compétente ou l’entité autorisée rend compte à celui-ci de toutes les subventions qu’elle a octroyées aux étudiants admissibles durant l’année de prêt ou durant toute autre période déterminée par le ministre.
|
(3) L’autorité compétente ou l’entité autorisée rembourse au ministre toute somme que ce dernier lui a versée pour une année de prêt et qu’elle n’a pas octroyée à titre de subvention conformément aux articles 14.1 ou 14.2. Cette somme constitue une créance de Sa Majesté du chef du Canada dès l’expiration de l’année de prêt. »

|
