CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Order 2003-87-10-01 Amending the Domestic Substances List

Whereas the Minister of the Environment has been provided with information under section 81 of the Canadian Environmental Protection Act, 1999 (see footnote a)  in respect of the substances referred in the annexed order;

Whereas the Minister of the Environment and the Minister of Health are satisfied that the substances have been manufactured in or imported into Canada in excess of the quantity prescribed under the New Substances Notification Regulations by the person who provided the information;

Whereas the period for assessing the information under section 83 of that Act has expired;

And whereas no conditions under paragraph 84(1)(a) of that Act in respect of the substances remain in effect;

Therefore, the Minister of the Environment, pursuant to subsection 87(1) of the Canadian Environmental Protection Act, 1999 (see footnote b) , hereby makes the annexed Order 2003-87-10-01 Amending the Domestic Substances List.

ORDER 2003-87-10-01 AMENDING THE DOMESTIC SUBSTANCES LIST

AMENDMENTS

1. Part 1 of the Domestic Substances List (see footnote 1)  is amended by adding the following in numerical order:

2. Part 2 of the List is amended by adding the following in numerical order:

Significant New Activity for which substance is subject to subsection 81(3) of the Act
3115-49-9 N-S Any activity that does not include the substance being used as a corrosion inhibitor and metal deactivator for use in industrial lubricant additives.
The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
(a) a description of the proposed new activity in relation to the substance;
(b) the information specified in Schedule I to the New Substances Notification Regulations; and
(c) the information specified in subsections 3(1) to (4) of Schedule II to those Regulations.
The above information will be assessed within 90 days after it is received by the Minister.
All of the above is as prescribed in Significant New Activity Notice No. 11026, published in the Canada Gazette, Part I,
page 146, January 26, 2002.
90076-69-6 N-S Any activity involving the substance:
(1) importing it for any purpose other than using it as a component of industrial batteries; or
(2) manufacturing it in Canada.
The following information must be provided to the Minister, at least 90 days before the beginning of the proposed new activity:
(a) a description of the proposed new activity in relation to the substance;
(b) the information specified in Schedule I to the New Substances Notification Regulations;
(c) the information specified in subsections 3(1) to (4) of Schedule II to those Regulations; and
(d) the concentration of the substance in the final product as a result of the new activity.
The above information will be assessed within 90 days after it is received by the Minister.
All of the above is as prescribed in Significant New Activity Notice No. 12241, published in the Canada Gazette, Part I, page 2185, July 12, 2003.
149879-98-1 N-S Any activity other than importing it for use as a chemical additive in sub-surface treatment fluids used in oil and gas production.
  The following information must be provided to the Minister, at least 90 days prior to the commencement of the proposed new activity:
(a) a description of the proposed significant new activity in relation to the substance;
(b) the information specified in Schedule I to the New Substances Notification Regulations;
(c) the information specified in subsections 3(1) to (4) of Schedule II to those Regulations; and
(d) the concentration of the substance in the final product as a result of the new activity.
The above information will be assessed within 90 days after it is received by the Minister.
All of the above is as prescribed in Significant New Activity Notice No. 12498, published in the Canada Gazette, Part I,
page 3274, October 18, 2003.
164462-16-2 N-S Any activity other than importing it or manufacturing it for use in industrial water softeners or as a chelating agent intended for use in industrial or consumer detergents and cleaners.
  The following information must be provided to the Minister, at least 90 days prior to the commencement of the proposed new activity:
(a) a description of the proposed new activity in relation to the substance;
(b) the information specified in Schedule I to the New Substances Notification Regulations;
(c) the information specified in subsections 3(1) to (4) of Schedule II to those Regulations; and
(d) the concentration of the substance in the final product as a result of the new activity.
The above information will be assessed within 90 days after it is received by the Minister.
All of the above is as prescribed in Significant New Activity Notice No. 12499, published in the Canada Gazette, Part I,
page 3428, November 1, 2003.

4. This Order comes into force on the day on which it is registered.
