Vol. 141, No. 32 — August 11, 2007 Regulations Amending the Sulphur in Gasoline Regulations (Miscellaneous Program)Statutory authority Canadian Environmental Protection Act, 1999 Sponsoring department Department of the Environment REGULATORY IMPACT ANALYSIS STATEMENT (This statement is not part of the Regulations.) Description The proposed Regulations Amending the Sulphur in Gasoline Regulations (Miscellaneous Program) [hereinafter referred to as the "proposed Amendments"], made pursuant to section 140 of the Canadian Environmental Protection Act, 1999 (CEPA 1999), were developed to address recommendations made by the Standing Joint Committee for the Scrutiny of Regulations. While the proposed Amendments are of an administrative nature, they are required to improve the clarity of the Sulphur in Gasoline Regulations (hereinafter referred to as the "Regulations") as well as to achieve consistency between the English and French versions of the Regulations. These proposed Amendments would not change the purpose or intent of the Regulations. Proposed Amendments The proposed Amendments would align the French and English versions of the Regulations by replacing paragraph (c) of section 1.1 of the English version of the Regulations, "the gasoline is being imported, its concentration exceeds the concentration referred to in section 2. . .", with the following: "the gasoline is being imported, its sulphur concentration exceeds the concentration referred to in section 2. . ." to be consistent with "qui est importée, dont la concentration de soufre dépasse celle prévue à l'article 2 [...]" in the French version of the Regulations. These proposed Amendments would come into force on the day on which they are registered. Alternatives As the proposed Amendments are developed to provide greater clarity and consistency to the Regulations, no other alternatives were considered. Consultation The Minister of the Environment, on December 7, 2006, had provided the governments of the provinces and territories as well as Aboriginal representatives through the CEPA National Advisory Committee an opportunity to advise and comment on a draft of the proposed Amendments. No comments were received.

Notice is hereby given, pursuant to subsection 332(1) (see footnote a) of the Canadian Environmental Protection Act, 1999 (see footnote b), that the Governor in Council proposes, pursuant to section 140 of that Act, to make the annexed Regulations Amending the Sulphur in Gasoline Regulations (Miscellaneous Program). Any person may, within 60 days after the date of publication of this notice, file with the Minister of the Environment comments with respect to the proposed Regulations or a notice of objection requesting that a board of review be established under section 333 of that Act and stating the reasons for the objection. All comments and notices must cite the Canada Gazette, Part I, and the date of publication of this notice, and be addressed to the Chief, Fuels Section, Oil, Gas and Alternative Energy Division, Energy and Transportation Directorate, Department of the Environment, Ottawa, Ontario K1A 0H3. A person who provides information to the Minister of the Environment may submit with the information a request for confidentiality under section 313 of that Act. Ottawa, July 30, 2007
MARY O'NEILL REGULATIONS AMENDING THE SULPHUR IN GASOLINE REGULATIONS (MISCELLANEOUS PROGRAM) AMENDMENT 1. Paragraph 1.1(c) of the English version of the Sulphur in Gasoline Regulations (see footnote 1) is replaced by the following: (c) the gasoline is being imported, its sulphur concentration exceeds the concentration referred to in section 2 and the gasoline is accompanied by written evidence establishing that the gasoline will meet the requirements of these Regulations before the gasoline is used or sold; or COMING INTO FORCE 2.
