Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2006-034) on March 6, 2007, with respect to a complaint filed by Paradise Company (Paradise), of Toronto, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W3380-07A017/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of women's and men's swimsuits.
Paradise alleged that PWGSC issued an amendment to the men's swimsuit specification too near to the bid receipt date to allow it to enclose a required sample and, as such, prevented bidders from submitting bids on time. Paradise also alleged that this improperly favoured bidders with local manufacturers and discriminated against bidders with overseas subcontractors.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

EXPIRY OF ORDER
Hot-rolled carbon steel plate
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its order made on January 10, 2003, in Expiry Review No. RR-2001-006, continuing, with amendment, its findings made on October 27, 1997, in Inquiry No. NQ-97-001, concerning hot-rolled carbon steel plate originating in or exported from the People's Republic of China, the Republic of South Africa and the Russian Federation, is scheduled to expire (Expiry No. LE-2006-003) on January 9, 2008. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date. An expiry review will not be initiated unless the Tribunal decides that there is sufficient information to indicate that it is warranted.
The subject goods are defined as hot-rolled carbon steel plate and high-strength low-alloy plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 in. (+/- 610 mm) to 152 in. (+/- 3 860 mm) inclusive, and thicknesses from 0.187 in. (+/- 4.75 mm) to 4.0 in. (+/- 101.6 mm) inclusive, but excluding plate for use in the manufacture of pipe and tube (also known as skelp), plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), and plate produced to American Society for Testing and Materials specifications A515 and A516M/A516, grade 70 (also known as pressure vessel quality plate) in thicknesses greater than 3.125 in. (+/- 79.3 mm).
Persons or governments requesting or opposing the initiation of an expiry review of the said order should file 20 copies of written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal not later than March 30, 2007. Persons or governments should endeavour to base their submissions exclusively on public information; however, confidential information relevant to the issues before the Tribunal may be filed, if necessary, along with a comprehensive public summary or edited version thereof.
Submissions should address all relevant factors, including
- the likelihood of continued or resumed dumping of the goods;
- the likely volume and price ranges of dumped imports if dumping were to continue or resume;
- the domestic industry's recent performance, including trends in production, sales, market share and profits;
- the likelihood of injury to the domestic industry if the order were allowed to expire, having regard to the anticipated effects of a continuation or resumption of dumped imports on the industry's future performance;
- any other developments affecting, or likely to affect, the performance of the domestic industry;
- changes in circumstances, domestically or internationally, including changes in the supply of or demand for the goods, and changes in trends in, and sources of, imports into Canada; and
- any other matter that is relevant.
Where there are opposing views, each person or government that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other persons or governments. In these circumstances, the Tribunal will distribute copies of the public submissions to each person or government that filed a submission with the Tribunal. Persons or governments wishing to respond to the submissions must do so not later than April 10, 2007. If confidential submissions have been filed, the Secretary will notify persons or governments and instruct them on how they may access these submissions through qualified counsel. Qualified counsel who wish to have access to any confidential documents filed in these proceedings must file their notices of representation, declarations and undertakings, as well as the notices of participation signed by the parties that they represent.
The Tribunal will issue a decision on April 25, 2007, on whether an expiry review is warranted based on the submissions and representations received and the responses to them.
- If there is no request for a review, the Tribunal will not initiate a review and the order will expire on its expiry date.
- If the Tribunal decides that a review is not warranted, the order will expire on its expiry date. The Tribunal will issue its reasons not later than 15 days after its decision.
- If the Tribunal decides to initiate a review, it will issue a notice of expiry review.
The Tribunal's Draft Guideline on Expiry Reviews can be found on its Web site at www.citt-tcce.gc.ca. In addition to providing more detailed information on the proceeding whereby the Tribunal determines if an expiry review is warranted, the draft guideline explains how an expiry review is conducted if the Tribunal determines that one is warranted. In an expiry review, the President of the Canada Border Services Agency (CBSA) first determines whether the expiry of the order or finding is likely to result in the continuation or resumption of dumping or subsidizing of the goods. If the CBSA determines that the expiry of the order or finding in respect of any goods is likely to result in the continuation or resumption of dumping or subsidizing, the Tribunal will then conduct an inquiry to determine if the continued or resumed dumping or subsidizing is likely to result in injury or retardation. The Tribunal's notice of expiry review will provide more information on the expiry review process.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2006-046) from Acron Capability Engineering Inc. (Acron), of Ottawa, Ontario, concerning a procurement (Solicitation No. W8475-06BM04/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation is for the provision of technical investigations and engineering services in support of various simulation devices identified under the Canadian Advanced Synthetic Environment program. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint. Interested parties were advised of the Tribunal's decision on March 5, 2007.
Acron alleges that PWGSC awarded the contract to a bidder whose proposal should have been deemed non-compliant and that there is an apprehension of bias towards that bidder.

Broadcasting licence fees Part I
The Broadcasting Licence Fee Regulations, 1997 (the Regulations) provide for the payment of a Part I licence fee by certain broadcasting undertakings. Subsection 9(1) of the Regulations sets out the components for the calculation of the regulatory costs.
Pursuant to section 10 of the Regulations, the Commission hereby announces that the estimated total broadcasting regulatory costs of the Commission for the 2007-2008 fiscal year are $26.449 million.
The annual adjustment amount referred to in subsection 8(2) for fiscal year 2005-2006 is $1.648 million.
The net billing for the Part I licence fee for fiscal year 2007-2008, taking into account the adjustment in paragraph 3 above, is $28.097 million.

REQUEST FOR PANEL REVIEW
Certain copper pipe fittings
Notice is hereby given, in accordance with the Special Import Measures Act (as amended by the North American Free Trade Agreement Implementation Act), that on March 2, 2007, a Request for Panel Review of the final determination of dumping made by the Canada Border Services Agency, respecting Certain copper pipe fittings originating in or exported from the United States of America, was filed by counsel for Mueller Industries, Inc. (Memphis, Tennessee), Streamline Copper & Brass Ltd. (Strathroy, Ontario) and affiliated companies within the Mueller Group, with the Canadian Section of the NAFTA Secretariat, pursuant to Article 1904 of the North American Free Trade Agreement.
The final determination was published in the Canada Gazette, Part I, on February 3, 2007 (Vol. 141, No. 5).
The panel review will be conducted in accordance with the NAFTA Article 1904 Panel Rules. Subrule 35(1)(c) of the abovementioned rules provides that
(i) a Party or interested person may challenge the final determination in whole or in part by filing a Complaint in accordance with rule 39 within 30 days after the filing of the first Request for Panel Review (the deadline for filing a Complaint is April 2, 2007);
(ii) a Party, an investigating authority or other interested person who does not file a Complaint but who intends to participate in the panel review shall file a Notice of Appearance in accordance with rule 40 within 45 days after the filing of the first Request for Panel Review (the deadline for filing a Notice of Appearance is April 16, 2007); and
(iii) the panel review will be limited to the allegations of error of fact or law, including challenges to the jurisdiction of the investigating authority, that are set out in the Complaints filed in the panel review and to the procedural and substantive defenses raised in the panel review.

Explanatory note
Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.
These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.
Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.

NATIONAL ENERGY BOARD
APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES
Beyond Energy & Trade Inc.
By an application dated February 23, 2007, Beyond Energy & Trade Inc. (the "Applicant") has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export up to 1 000 MW/8 760 GWh of combined firm and interruptible energy per year, for a period of 20 years.
The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.
1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices at 61 Saint-Charles Street W, Suite 62, Longueuil, Quebec J4H 1C5, Canada, 450-646-2888 (telephone), 450-646-0980 (fax). The Applicant will provide a copy of the application to any person who requests one.

(a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
(b) the impact of the exportation on the environment; and
(c) whether the Applicant has
(i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
(ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.
4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of the notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by May 1, 2007.
