CANADA SHIPPING ACT

Regulations Amending the Ship Station (Radio) Technical Regulations, 1999 (Miscellaneous Program)

The Minister of Transport, Infrastructure and Communities, pursuant to section 343 (see footnote a) of the Canada Shipping Act, hereby makes the annexed Regulations Amending the Ship Station (Radio) Technical Regulations, 1999 (Miscellaneous Program).

REGULATIONS AMENDING THE SHIP STATION (RADIO) TECHNICAL REGULATIONS, 1999 (MISCELLANEOUS PROGRAM)

AMENDMENTS

1. Subsection 1(4) of the French version of the Ship Station (Radio) Technical Regulations, 1999 (see footnote 1) is replaced by the following:

(4) Sauf disposition contraire du présent règlement, toute mention d'une norme ou d'un document incorporés par renvoi constitue un renvoi à la norme ou au document avec ses modifications successives.

2. Subsection 2(2) of the Regulations is replaced by the following:

(2) Sections 3, 4, 7, 33 and 35 to 37, paragraph 39(1)(b), subsection 39(2), section 50 and subsection 51(2) also apply in respect of a ship station, including radio equipment, documentation and other equipment for the station, on board a non-Canadian ship not engaged in the coasting trade, when navigating in Canadian waters.

3. The portion of section 5 of the French version of the Regulations before paragraph (a) is replaced by the following:

5. Lorsque l'équipement de radiocommunication permet de préciser automatiquement la position du navire lors d'une alerte en cas de détresse, la position du navire et l'heure à laquelle il était à cette position doivent être disponibles pour être transmises par l'équipement :

4. (1) Paragraph 6(1)(a) of the Regulations is repealed.

(2) Subsection 6(2) of the French version of the Regulations is replaced by the following:

(2) Avant le 1er février 2003, tout équipement de radiocommunication permettant la transmission et la réception des communications au moyen de l'ASN ou toute station terrienne de navire INMARSAT, installés à bord d'un navire avant le 1er avril 2001 et qui ne sont pas munis de bouton de détresse réservé et protégé ou qui n'exigent pas au moins deux gestes indépendants pour envoyer un signal de détresse doivent, selon le cas :

a) être modifiées pour qu'elles soient munies d'un bouton de détresse réservé et protégé ou qu'elles exigent au moins deux gestes indépendants pour envoyer un signal de détresse;

b) être remplacées par de l'équipement muni d'un bouton de détresse réservé et protégé.

5. Paragraph 13(c) of the French version of the Regulations is replaced by the following:

c) être munies d'un dispositif pour les recharger entièrement dans un délai de 10 heures.

6. The portion of paragraph 28(b) of the Regulations before subparagraph (i) is replaced by the following:

(b) be certified by a country to which the Safety Convention applies as having passed the tests set out in standard

7. Paragraphs 30(2)(a) and (b) of the French version of the Regulations are replaced by the following:

a) les radiotéléphones VHF qui, avant le 23 novembre 1996, étaient à bord d'un navire ressortissant à la Convention de sécurité, soient encore à bord de ce navire;

b) les radiotéléphones VHF qui, avant le 1er juin 1997, était à bord d'un navire ne ressortissant pas à la Convention de sécurité, soient encore à bord de ce navire.

8. Subsection 37(1) of the French version of the Regulations is replaced by the following:

37. (1) Le signal de détresse ou l'alerte de détresse prévu par le Règlement international des radiocommunications est utilisé lorsqu'un navire ou une personne se trouve dans une situation de danger grave et imminente qui nécessite une assistance immédiate. La présente disposition n'a pas pour effet d'interdire, dans une situation de détresse, à un navire, à un bateau de sauvetage ou à une personne d'utiliser tout autre signal pour transmettre sa position et obtenir de l'aide.

9. These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Description

The Regulations Amending the Ship Station (Radio) Technical Regulations, 1999 (Miscellaneous Program) deal with issues raised by the Standing Joint Committee for the Scrutiny of Regulations (SJC). The Regulations prescribe the technical characteristics, installation requirements and the operation and inspection of ship stations required by the Ship Station (Radio) Regulations, 1999, to be fitted onboard Canadian ships and foreign ships operating in Canadian waters.

The SJC noted that in the French version of subsection 1(4), reference to a standard or document incorporated by reference "from time to time" is expressed as "dans son état modifié". The expression is replaced by "avec ses modifications successives" which is the expression more commonly used.

The SJC pointed out that SOR/2005-137 repealed section 38 of the Regulations. Subsection 2(2) is therefore replaced to delete reference to section 38 from that provision.

The French version of the portion of section 5 before paragraph (a) is amended at the suggestion of the SJC in order to clarify that the time in question in this section is the time at which the ship was at the position that is automatically provided by the radio equipment in the case of a distress alert.

The SJC noted that the reference to "the performance standards in force on March 31, 2001" in paragraph 6(1)(a) of the Regulations was vague. Upon review, it was determined that the only condition that matters for the purposes of subsection 6(1) is the one set out in paragraph 6(1)(b). Paragraph 6(1)(a) is therefore repealed. The French version of subsection 6(2) is amended to clarify that provision's meaning.

The SJC noted an anomaly between the English and French versions in paragraph 13(c). The English version refers to "fully" charging the batteries whereas the French version does not specify that the batteries are to be "fully" charged. The French version is amended to include the requirement.

Paragraph 28(b) is amended to make the wording consistent with that used in subparagraph 25(a)(ii).

The French versions of paragraphs 30(2)(a) and (b) are amended by replacing the words "et qui sont encore à bord" with the SJC's preferred wording "soient encore à bord".

The SJC noted that it was not clear in the second sentence of the French version of subsection 37(1) whether "en détresse" applied to all the elements listed in front of it or just to "une personne". The subsection is amended to make it clear that all the elements are included.
