Railway Works Filing of Affidavits Regulations



REGULATIONS RESPECTING THE FILING OF AFFIDAVITS ON THE

COMPLETION OF RAILWAY WORKS

Short Title

1. These Regulations may be cited as the Railway Works Filing of Affidavits Regulations.

Interpretation

2. In these Regulations, "classification" means a classification of road as shown on Tables A.3 and H.3.1 of the Manual of Geometric Design Standards for Canadian Roads published by the Roads and Transportation Association of Canada and the Normes canadiennes de conception geometrique des routes published by L'Association quebecoise du transport et des routes, as amended from time to time; (classe)

Prescribed Kinds of Works

3. For the purpose of subsection 11(2) of the Railway Safety Act, the following are prescribed as works of a kind for which an affidavit must be filed:

(a) railway bridges and culverts having an overall span greater than 6 metres and railway tunnels;

(b) structures, excluding railway signal and communication structures, over a line of railway;

(c) road crossings of public roads that involve

(i) the construction of a new crossing,

(ii) the upgrading of the road classification because of an increase in the number of lanes or in the design speed or service functions,

(iii) the addition of one or more railway tracks at an existing road crossing, or

(iv) the installation or alteration of road crossing warning signals and associated equipment but excluding road crossing signs; and

(d) new signal and communications systems used to control the movement of railway equipment.
