Problem:
|
London Drugs imported approximately 100 Evenflo Sightseer Booster seats
from a United States based clearing house. These booster seats do not
fully comply with all applicable standards and regulations under the
Canada Motor Vehicle Safety Act.

Background:
|
A call was received by Manitoba Public Insurance (MPI)
from a consumer in concerning an Evenflo Sightseer booster seat that had
been purchased at London Drugs. She was concerned that the minimum
weight indicated on the labelling was 30 pounds. MPI forwarded the
enquiry to Transport Canada. On review of the booster seat with the
consumer, it was verified that the booster seat was manufactured for the
U.S. market, as it did not have the required Canadian labelling.
Transport Canada contacted Evenflo Canada to discuss the importation of
the booster seats into Canada. It has been determined that this model of
booster seat has not been available in Canada for approximately one year
and that these particular booster seats had been supplied directly to
London Drugs by a United States based clearing house and not by Evenflo
Company Inc.

Company Action
|
Upon notification by Transport Canada, London Drugs has voluntarily
removed the booster seats from their stores. In addition, they have
published a notice on their web site and have the publication posted in
all their stores. As the booster seats were not sold directly to London
Drugs by the manufacturer, Evenflo is not involved in this Public
Notice.

Safety Risk:
|
The labelling on the booster seats states the minimum weight for use
is 30 pounds. The Canada Motor Vehicle Safety Standard - Booster
Cushions (CMVSS 213.2) states that the minimum weight for use must be
40 pounds. Should an underweight child be placed in the booster seat
and the vehicle is involved in a collision, specifically a roll-over
event, the child could be seriously injured due to ejection or partial
ejection. |

Consumer Recourse:
|
Any individual who has purchased this model of booster cushion from
London Drugs should return the booster to the retail outlet for a full
refund with or without a receipt.
