Waterproof Footwear and Waterproof Footwear Bottoms Decision
On July 17, 2002, pursuant to paragraph 39(1)(a) of the Special Import Measures Act, the Commissioner of Customs and Revenue extended to 135 days the time period for rendering the preliminary decision respecting the alleged injurious dumping into Canada of certain waterproof footwear and waterproof footwear bottoms, constructed wholly or in part of rubber or plastic, worn over the foot or shoe, originating in or exported from Hong Kong, China; Macao, China; and Vietnam.
Consequently, the preliminary decision by the Commissioner of Customs and Revenue will be made on or before September 9, 2002.
The distinctive feature of waterproof footwear is that both the sole portion and a portion of the upper, sufficient to give waterproof protection to the foot, are incorporated in a waterproof component, which may be made of rubber or plastic. The goods subject to this investigation include moulded clogs, waterproof safety footwear and waterproof footwear made of waterproof footwear bottoms combined with tops made of leather, textiles or other materials. They may be constructed with or without liners, linings, fasteners or safety features.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2000-018R) on July 31, 2002, further to a judgment by the Federal Court of Appeal, which remitted, in part, to the Tribunal its determination in File No. PR-2000-018 (Xwave Solutions Inc.) and directed the Tribunal to consider only the aspect of Xwave Solutions Inc.'s complaint relating to Article 504(3) of the Agreement on Internal Trade.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2002-006) on July 29, 2002, with respect to a complaint filed by XIA Information Architects Corporation (the complainant), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. DND-01/0336) by the Department of National Defence (DND). The solicitation was for the services of an information technology and project support specialist.
It was alleged that DND improperly declared the complainant's bid non-compliant. It was further alleged that, in assessing the complainant's proposal, evaluation criteria were inappropriately applied and that biased tender specifications and ambiguous or indefinite evaluation factors were used.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade and the North American Free Trade Agreement, the Tribunal determined that the complaint was valid.
