SPECIAL IMPORT MEASURES ACT

Automotive Laminated Windshields — Decision

On July 31, 2002, the Commissioner of Customs and Revenue made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act respecting automotive laminated windshields for the automotive replacement market, of all sizes and shapes, whether they are clear or tinted, whether coated or not, whether or not they include antennae, ceramics, mirror buttons, vehicle identification number notches, and whether or not they are encapsulated, originating in or exported from the People's Republic of China.

The goods in question are usually classified under the following Harmonized System classification number: 7007.21.00.21.

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury and will make its order or finding by August 30, 2002. Provisional duty will continue to apply until this date.

If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to an anti-dumping duty equal to the margin of dumping. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-019) from Plan B Systems Inc. (the complainant), of Ottawa, Ontario, concerning a procurement (Solicitation No. ECSS-RFP2002-04-19) by Elections Canada (EC). This solicitation is for the development of business continuity plans. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that EC wrongly evaluated the complainant's proposal based on criteria not contained in the Request for Proposal and, therefore, treated the complainant unfairly.
