The Abitibi-Consolidated Company of Canada, Fort William Division, hereby gives notice that an application has been made to the Minister of Fisheries and Oceans under the Navigable Waters Protection Act for approval of the plans and site of the work described herein. Under section 9 of the said Act, Abitibi-Consolidated Company of Canada, Fort William Division, has deposited with the Minister of Fisheries and Oceans, and in the office of the District Registrar of the Land Registry District of Thunder Bay, at 189 Red River Road, Thunder Bay, Ontario, under deposit number 426093, a description of the site and plans of a bridge over Armistice Creek, approximately 3 km upstream from the mouth of the Mooseland River, approximately 140 km north of Thunder Bay, Ontario.

BANK OF CANADA

NOTICE OF DESIGNATION TO CLS BANK INTERNATIONAL

Under subsection 4(1) of the Payment Clearing and Settlement Act (the "Act"), where the Governor of the Bank of Canada is of the opinion that a clearing and settlement system may be operated in such a manner as to pose systemic risk, the Governor may, if the Minister of Finance is of the opinion that it is in the public interest to do so, designate the clearing and settlement system as a system that is subject to Part I of the Act.

CLS Bank International is a banking institution organized under the laws of the United States of America. It provides a settlement service to its members for the settlement of payment obligations and entitlements arising from foreign exchange transactions (the "CLS Bank Settlement Service"). The CLS Bank Settlement Service settles payment obligations and entitlements partly in Canadian dollars and more than one of the participants in the Service are banks incorporated in Canada. The CLS Bank Settlement Service is a clearing and settlement system as defined in the Act, having its clearing house (CLS Bank International) located outside of Canada.

I am of the opinion that the CLS Bank Settlement Service may be operated in such a manner as to pose systemic risk, if it were not properly risk-proofed, and therefore should be designated as subject to Part I of the Act. The Minister of Finance is of the opinion that it would be in the public interest to designate the CLS Bank Settlement Service.

Accordingly, as required by subsection 4(2) of the Act, this is to provide CLS Bank International with written notice that the CLS Bank Settlement Service is hereby designated pursuant to subsection 4(1) of the Act. Pursuant to subsection 22(1) of the Act, any action that the Bank of Canada may take in respect of a clearing house will, in the case of CLS Bank International, only be taken in respect of the Canadian banks which participate in the CLS Bank Settlement Service.
