Xanthates — Decision

On August 28, 2002, pursuant to paragraph 39(1)(a) of the Special Import Measures Act, the Commissioner of Customs and Revenue extended to 135 days, the time period for rendering the preliminary decision respecting the alleged injurious dumping into Canada of xanthates of all grades in dry or liquid forms, excluding cellulose xanthates, originating in or exported from the People's Republic of China. Consequently, the preliminary decision by the Commissioner of Customs and Revenue will be made on or before November 4, 2002.

Application for Certification: Directors Guild of Canada — Tribunal File No. 1310-02-003

In accordance with subsection 25(3) of the Status of the Artist Act, the Canadian Artists and Producers Professional Relations Tribunal hereby gives notice that it has received an application for certification from the Directors Guild of Canada (DGC). The DGC is seeking certification to represent a sector composed of all professional independent contractors engaged in all productions by a producer subject to the Status of the Artist Act to perform the function of director, first assistant director, second assistant director and third assistant director, excluding:

(a) the artists covered by the certification granted to the Association des réalisateurs et réalisatrices du Québec (ARRQ) by the Canadian Artists and Producers Professional Relations Tribunal on December 30, 1997; and

(b) the assistant directors in Quebec for which an application for certification is pending before the Canadian Artists and Producers Professional Relations Tribunal (APVQ-STCVQ, file no. 1310-96-0026A).

Any artists' association that wishes to make a competing application for certification in respect of the same sector or any part of the same sector must file its application for certification no later than October 28, 2002. Any individual or organization that wishes to make representations to the Tribunal regarding the application must notify the Tribunal in writing of their interest no later than October 28, 2002.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination on September 3, 2002, with respect to a complaint (File No. PR-2002-003) filed by Polaris Inflatable Boats (Canada) Ltd. (the complainant), of Langley, British Columbia, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W8472-01MM02/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The solicitation was for the supply and delivery of 40 rigid inflatable boats with aluminum hulls, as well as engineering drawings, associated lists and reference documents.

The complainant alleged that the Request for Proposal contained restrictive mandatory requirements.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2002-012) on September 3, 2002, with respect to a complaint filed by K-W Leather Products Ltd. (the complainant), of Waterloo, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W8476-019901/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for tactical vests.

The complainant alleged that PWGSC applied evaluation criteria that were not clearly stated or not stated at all in the solicitation document.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

FINDING

Automotive Laminated Windshields

In the matter of an inquiry, under section 42 of the Special Import Measures Act, respecting automotive laminated windshields for the automotive replacement market, of all sizes and shapes, whether they are clear or tinted, whether coated or not, whether or not they include antennae, ceramics, mirror buttons, VIN notches, and whether or not they are encapsulated, originating in or exported from the People's Republic of China

The Canadian International Trade Tribunal, under the provisions of section 42 of the Special Import Measures Act, has conducted an inquiry (Inquiry No. NQ-2002-001) to determine whether the dumping in Canada of automotive laminated windshields for the automotive replacement market, of all sizes and shapes, whether they are clear or tinted, whether coated or not, whether or not they include antennae, ceramics, mirror buttons, VIN notches, and whether or not they are encapsulated, originating in or exported from the People's Republic of China, has caused injury or retardation or is threatening to cause injury to the domestic industry.

This inquiry is pursuant to the issuance by the Commissioner of the Canada Customs and Revenue Agency of a preliminary determination dated May 2, 2002, and of a final determination dated July 31, 2002, that the aforementioned goods have been dumped and that the margin of dumping of the goods is not insignificant.

Pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby finds that the dumping of the aforementioned goods originating in or exported from the People's Republic of China has not caused material injury and is not threatening to cause material injury to the domestic industry.

The statement of reasons will be issued within 15 days.

PUBLIC NOTICE 2002-51

Cable Inside Wire Fee

In the public notice, the Commission establishes a fee for the use of cable inside wire in multiple-unit dwellings (MUDs) pursuant to subsection 10(2) of the Broadcasting Distribution Regulations. The fee is based on the methodology set out in Call for comments — cable inside wire lease fee, Public Notice CRTC 2002-13, March 8, 2002, with certain modifications arising from the comments received pursuant to the public notice. Based on this methodology, the Commission considers that a fee of $0.52 per subscriber per month is a just and reasonable fee for the use of inside wire in MUDs.

MACKENZIE VALLEY LAND AND WATER BOARD

NORTHWEST TERRITORIES WATERS ACT

Public Hearing

The Mackenzie Valley Land and Water Board has proposed an amendment of the term of Type "A" Water License N3L20004 for Mining and Milling at Tungsten, Northwest Territories.

A public hearing will be held, under subsection 21(2) of the Northwest Territories Waters Act, by the Board on October 22, 2002, starting at 1 p.m., at the Hamlet of Fort Liard Community Hall, Fort Liard, Northwest Territories, to receive input from the public respecting a proposal to amend the term of Water Licence N3L20004. The proposed amendment would extend the term by one year, to expire on November 29, 2003. This proposed extension is intended to allow North American Tungsten to continue its current activities unchanged while the environmental assessment process is taking place.

Written submissions in relation to this proposal must be submitted to the Office of the Board by 4 p.m., September 30, 2002.
