SPECIAL IMPORT MEASURES ACT

Waterproof Footwear and Waterproof Footwear Bottoms — Decision

On September 9, 2002, the Commissioner of Customs and Revenue made a preliminary determination of dumping, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), respecting certain waterproof footwear and waterproof footwear bottoms, constructed wholly or in part of rubber or plastic, worn over the foot or shoe, originating in or exported from Hong Kong, China; Macao, China; and Vietnam.

For additional information, the goods subject to the investigation exclude the following:

— Equestrian riding boots designed for use in horse riding;

— Ski boots designed for use in down-hill skiing; and

— Skating boots designed to be fitted with skate blades and used for ice skating.

The subject goods in finished form are normally classified under Harmonized System headings 6401, 6402, 6403 and 6404.

The Canadian International Trade Tribunal (Tribunal) will make a full inquiry into the question of injury to the domestic industry and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determination of dumping.

Pursuant to section 8 of SIMA, provisional duty is payable on subject goods released from customs during the period commencing on the date the preliminary determination was made and ending on the earlier of the day the investigation is terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted. The amount of provisional duty payable is not greater than the estimated margin of dumping. The payment of such provisional duty is hereby demanded.

NATIONAL ENERGY BOARD

APPLICATION FOR AUTHORIZATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Manitoba Hydro

Notice is hereby given that, by an application dated September 26, 2002, Manitoba Hydro (the "Applicant") has applied to the National Energy Board (the "Board"), under Division II of Part VI of the National Energy Board Act (the "Act"), for authorization to export a maximum of 500 megawatts of system participation power from May 1, 2005, to April 30, 2015. This export would be in accordance with the terms of the Power Sale Agreement between Manitoba Hydro and Northern States Power, effective August 1, 2002.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The Directions on Procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its office located at 820 Taylor Avenue, Winnipeg, Manitoba, and provide a copy of the application to any person who requests a copy. A copy of the application is also available for viewing during normal business hours in the Board's Library, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8.

2. Written submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8, (403) 292-5503 (Facsimile), and with Manitoba Hydro, to the attention of K. Jennifer Moroz, Barrister and Solicitor, 820 Taylor Avenue, Winnipeg, Manitoba R3C 2P4, by October 28, 2002.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submitters with respect to:

    (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
    (b) the impact of the exportation on the environment; and
    (c) whether the Applicant has:
      (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
      (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedures shall be filed with the Secretary of the Board and served on the party that filed the submission, by November 12, 2002.

5. Any reply that submitters wish to present in response to item 4 of this Notice of Application and Directions on Procedure shall be filed with the Secretary of the Board and served on the Applicant by November 22, 2002.
