The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-005) from SPMgroup Ltd., of Toronto, Ontario, concerning a procurement (Solicitation No. DND 2002/0063) by the Department of National Defence (DND). The requirement is for the delivery of a generic project management course. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that DND improperly applied a mandatory criteria set out in the Request for Proposal.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-003) from Polaris Inflatable Boats (Canada) Ltd., of Langley, British Columbia, concerning a procurement (Solicitation No. W8472-01MM02/A) by the Department of Public Works and Government Services on behalf of the Department of National Defence. The requirement is for the supply and delivery of 40 rigid inflatable boats with aluminum hulls, as well as engineering drawings, associated lists and reference documents. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that the Request for Proposal contains restrictive mandatory requirements.

Pursuant to paragraph 76.01(5)(a) of the Special Import Measures Act, the Canadian International Trade Tribunal hereby rescinds its order made on November 28, 1997, in Review No. RR-97-002, continuing, without amendment, its finding made on November 30, 1992, in Inquiry No. NQ-92-001, concerning fresh Iceberg (head) lettuce, originating in or exported from the United States of America, for use or consumption in the province of British Columbia.

In the matter of an expiry review (Expiry Review No. RR-2001-003), under subsection 76.03(3) of the Special Import Measures Act, of the order made by the Canadian International Trade Tribunal on April 21, 1997, in Review No. RR-96-004, continuing with amendment, its finding made on April 21, 1992, in Inquiry No. NQ-91-006, concerning machine tufted carpeting with pile predominantly of nylon, other polyamide, polyester or polypropylene yarns, excluding automotive carpeting and floor coverings of an area less than five square metres, originating in or exported from the United States of America

On August 9, 2001, the Canadian International Trade Tribunal (the Tribunal) gave notice that, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), it would initiate an expiry review of its order made on April 21, 1997, in Review No. RR-96-004, continuing with amendment, its finding made on April 21, 1992, in Inquiry No. NQ-91-006, concerning machine tufted carpeting with pile predominantly of nylon, other polyamide, polyester or polypropylene yarns, excluding automotive carpeting and floor coverings of an area less than five square metres, originating in or exported from the United States of America.

On December 7, 2001, the Commissioner, pursuant to paragraph 76.03(7)(a) of SIMA, determined that the expiry of the order made by the Tribunal on April 21, 1997, in Review No. RR-96-004, concerning the above-mentioned goods was unlikely to result in the continuation or resumption of dumping of the goods.

Pursuant to subparagraph 76.03(12)(a)(i) of SIMA, the Tribunal hereby rescinds the order made in Review No. RR-96-004, concerning the above-mentioned goods.

CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION

PUBLIC NOTICE 2002-20

Review of Exemption Orders for Experimental Video-on-Demand Programming Undertakings, Video Games Programming Service Undertakings and Teleshopping Programming Service Undertakings

1. The Commission issues exemption orders pursuant to subsection 9(4) of the Broadcasting Act (the Act), which provides as follows:

The Commission shall, by order, on such terms and conditions as it deems appropriate, exempt persons who carry on broadcasting undertakings of any class specified in the order from any or all of the requirements of this Part or of a regulation made under this Part where the Commission is satisfied that compliance with those requirements will not contribute in a material manner to the implementation of the broadcasting policy set out in subsection 3(1).

2. In Policy Regarding the Use of Exemption Orders, Public Notice CRTC 1996-59, April 26, 1996, the Commission stated that it would conduct a periodic review of exemption orders between five and seven years following the date of their issuance. Appended to the integral version of this notice are the three exemption orders (collectively "the orders") that are now due for such a review. The orders are:

— Exemption Order Respecting Experimental Video-on-Demand Programming Undertakings, as set out in the Appendix to Exemption Order Respecting Experimental Video-on-Demand Programming Undertakings, Public Notice CRTC 1994-118, September 16, 1994;

— Exemption Order Respecting Video Games Programming Service Undertakings, as set out in the Appendix to Policy Governing the Distribution of Video Games Programming Service Undertakings, Public Notice CRTC 1995-5, January 13, 1995; and

— Exemption Order Respecting Teleshopping Programming Service Undertakings, as set out in the Appendix to Exemption Order Respecting Teleshopping Programming Service Undertakings, Public Notice CRTC 1995-14, January 26, 1995.

3. To ensure that all interested parties have an adequate opportunity to participate in the review, including those operating undertakings affected by the orders, the Commission hereby initiates a process consisting of two rounds of written comments. In the first round, interested parties are requested to provide comments on the orders, including their views on whether the orders should continue in effect. Parties wishing to respond to comments filed in the first round will have an opportunity to do so during the second round as set out below.

Procedures for filing comments

4. The deadline for the submission of written comments in the first round is June 25, 2002. These initial comments will be made available for examination by the public as soon as possible following the deadline.

5. Interested parties, regardless of whether or not they have participated in the first round, will then have an opportunity to reply to the comments filed during that round. These second-round replies must be submitted by no later than August 26, 2002.

6. The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.

7. Interested parties can file their comments on paper, on diskette or by electronic mail. Submissions longer than five pages should include a summary. Parties wishing to file their comments on paper or on diskette should send them to the Secretary General, Canadian Radio-Television and Telecommunications Commission, Ottawa, Ontario K1A 0N2. Parties wishing to file their comments by electronic mail can do so by sending them to the following address: procedure@crtc.gc.ca.

8. Electronic submissions should be in the HTML format. As an alternative, those making submissions may use "Microsoft Word" for text and "Microsoft Excel" for spreadsheets.

9. Please number each paragraph of your submission. In addition, please enter the line ***End of document*** following the last paragraph. This will help the Commission verify that the document has not been damaged during transmission.

10. The Commission will make comments filed in electronic form available on its Web site at www.crtc.gc.ca in the official language and format in which they are submitted. Comments filed on paper will be available in the public examination file.

11. The Commission also encourages interested parties to monitor the public examination file (and/or the Commission's Web site) for additional information that they may find useful when preparing their comments.

NATIONAL ENERGY BOARD

PUBLIC HEARING

Department of Natural Resources and Energy of New Brunswick

The National Energy Board (the "Board") has issued Hearing Order MH-2-2002 and Directions on Procedure with respect to an application filed by the Department of Natural Resources and Energy of New Brunswick (the "Applicant"), under paragraph 12(1)(b) and subsections 21(1) and 24(3) of the National Energy Board Act, for a hearing to establish a set of rules that will apply when the Board considers applications for short-term export orders for incremental supplies of Scotian offshore gas if those supplies cannot meet both domestic and export requests for service. The application is available for viewing during normal business hours at the following locations: Department of Natural Resources and Energy, Energy Division, Hugh John Flemming Forestry Centre, Room 150, 1350 Regent Street, Fredericton, New-Brunswick; and National Energy Board, Library, Main Floor, 444 Seventh Avenue SW, Calgary, Alberta.

The oral public hearing is scheduled to commence at 9 a.m. on Monday, July 15, 2002, at the Sheraton Fredericton Hotel, 225 Woodstock Road, Fredericton, New Brunswick. The hearing will be held to obtain the evidence and views of interested parties on the application.
