Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2001-071) on June 5, 2002, with respect to a complaint filed by Équipement Industriel Champion Inc. (the complainant), of Québec, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. W0138-016059/A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for the supply and installation of a hydraulic lift, parallelogram type.

The complainant alleged that PWGSC improperly awarded the contract to a non-compliant bidder.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2001-056) on June 5, 2002, with respect to a complaint filed by ACMG Management Inc. (the complainant), of Gatineau, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, as amended by the North American Free Trade Agreement Implementation Act, S.C. 1993, c. 44, concerning a procurement (Solicitation No. E60BQ-000SAD/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the services of a Senior Life Cycle Technologist in support of the Aviation Life Support Equipment Project.

The complainant alleged that PWGSC improperly evaluated a submission from another bidder as being compliant.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid in part.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2002-010) from DBS International, of Ottawa, Ontario, concerning a Request for Supply Arrangement (Solicitation No. M0077-1-C403) by the Royal Canadian Mounted Police (RCMP). The solicitation is for the provision of strategic advice and consulting services for "strategic planning and change management." Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

It is alleged that the evaluation process carried out by the RCMP was unfair and contrary to the Agreement on Internal Trade.

Call for Applications for a Broadcasting Licence to Carry on a Radio Programming Undertaking to Serve Edmonton, Alberta

The Commission announces that it has received an application for a broadcasting licence to provide a commercial radio service to serve Edmonton, Alberta.

The Commission hereby calls for applications from other parties wishing to obtain such a radio licence to serve the Edmonton area.

Persons interested in responding to this call must submit a formal application to the Commission no later than September 4, 2002. Applicants are also required to submit all necessary technical documentation to the Department of Industry by the same date.

It should be noted that, in making this call, the Commission has not reached any conclusion with respect to the licensing of such a service, nor should it necessarily be construed that the Commission will, by virtue of having called for applications, authorize such a service at this time.

Applicants will be required to provide evidence giving clear indication that there is a demand and a market for the station and the proposed service. Without restricting the scope of the issues to be considered, the following matters should be addressed in the application:

1. The contribution that the proposed service will make to achieving the objectives established in the Broadcasting Act and, in particular, to the production of local and regional programming.

2. The factors relevant to the evaluation of applications, as outlined in Decision CRTC 1999-480 dated October 28, 1999.

3. The means by which the applicant will promote the development of Canadian talent, including local and regional talent.

4. An analysis of the markets involved and potential advertising revenues, taking into account the results of any survey undertaken supporting the estimates. The financial summary for the Edmonton radio market is attached to the integral version of this call.

5. Evidence as to the availability of financial resources consistent with the requirements established in the financial projections of the applicant's business plan. For the convenience of applicants, the Commission has available, upon request, a document entitled "Commission Policy Regarding Documentary Evidence to Confirm the Availability of Financing."

The Commission also reminds applicants that they must comply with the eligibility requirements set out in the Direction to the CRTC (Ineligibility of Non-Canadians), SOR/97-192, dated April 8, 1997, as amended by SOR/98-378, dated July 15, 1998, and the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences), SOR/85-627, dated June 27, 1985, as amended by SOR/97-231, dated April 22, 1997.

The Commission will announce at a later date the public process for considering applications and where they may be examined by the public. As part of that process, the public will be given the opportunity to comment on any application by submitting written interventions to the CRTC.

Notice of each application will also be published in newspapers of general circulation within the area to be served.

Notice is hereby given that on May 31, 2002, an application under sections 92 and 105 of the Competition Act, R.S.C. 1985, c. C-34 (the "Act"), was filed with the undersigned at the Competition Tribunal by the Commissioner of Competition appointed under the Act, in the matter of the acquisition by Bayer AG of all the shares of Aventis CropScience Holding S.A., constituting the agrochemical business of Aventis S.A. and, in Canada, the indirect acquisition by Bayer AG of all the shares of Aventis CropScience Canada Co. The respondents in this application are Bayer AG and Aventis CropScience Holding S.A.

Particulars of the orders sought:

    (a) an order pursuant to section 92 and 105 of the Act requiring the Respondents to divest such further or other shares or assets as the Tribunal considers necessary to address the substantial lessening or prevention of competition which is likely to result from the acquisition of Aventis CropScience Holding S.A. by Bayer AG; and
    (b) such further orders as may be appropriate.

Notice is hereby given, pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, that the binational panel review of the Final Determination of Sales at Less Than Fair Value made by the United States Department of Commerce, International Trade Administration, respecting greenhouse tomatoes from Canada is completed. Pursuant to subrule 78(a) of the NAFTA Article 1904 Panel Rules, this Notice of Completion of Panel Review is effective on May 29, 2002, the day the Consent Motion to terminate the binational panel review of this matter was filed (Secretariat File No. USA-CDA-2002-1904-04).

Also, notice is hereby given that the Request for Panel Review of the Amended Final Determination of Sales at Less Than Fair Value made by the United States Department of Commerce, International trade Administration, respecting greenhouse tomatoes from Canada has been withdrawn by the requester as of May 20, 2002 (Secretariat File No. USA-CDA-2002-1904-06)

Explanatory Note

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in anti-dumping and countervailing duty panel reviews involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to expeditiously review final determinations to determine whether they are in accordance with the anti-dumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement that came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the NAFTA Article 1904 Panel Rules. These Rules were published in the Canada Gazette, Part I, on January 1, 1994.
