BUDGET IMPLEMENTATION ACT, 2006

Order Fixing November 10, 2006 as the Date of the Coming into Force of Certain Sections of the Act

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to section 213 of the Budget Implementation Act, 2006, assented to on June 22, 2006, being chapter 4 of the Statutes of Canada, 2006, hereby fixes November 10, 2006 as the day on which sections 208 to 212 of that Act come into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes November 10, 2006 as the day on which sections 208 to 212 of the Budget Implementation Act, 2006 come into force.

Section 208 of that Act enacts the Mackenzie Gas Project Impacts Act, whose purpose is to establish a new corporation, the Corporation for the Mitigation of Mackenzie Gas Project Impacts (the "Corporation"). The Corporation is not an agent of Her Majesty in right of Canada. The Act establishes the Corporation, authorizes the appointment of directors and the employment of staff and prescribes the scope of operations of the Corporation. The purposes of the Corporation are to provide contributions to regional organizations for projects that mitigate the existing or anticipated socio-economic impacts on communities in the Northwest Territories arising from the Mackenzie gas project.

Section 209 of the Budget Implementation Act, 2006 authorizes payments, not exceeding in the aggregate the sum of $500,000,000, to be made to the Corporation on the requisition of the Minister of Finance and on the recommendation of the Minister of Indian Affairs and Northern Development. No recommendation, however, may be made if the gas project has been terminated or if it is the opinion of the Minister of Indian Affairs and Northern Development that progress is not being made on the project.

Sections 210 to 212 of the Budget Implementation Act, 2006 make related and consequential amendments to other Acts in respect of the Mackenzie Gas Project Impacts Act.
